Hosting companies always cover their arses in that they bare no responsibility for what is hosted on their services.
Think of them like storage container companies.
It’s a don’t ask, don’t tell policy.
If someone is storing stolen goods, illegal weapons etc in a storage unit, it’s not the company’s responsibility.
The absolute best you could do is alert them to the contents of the site, which appears to already have been done in KF’s case.
It’s still up, the hosting company obviously sees nothing wrong, and if they see nothing wrong the judge will certainly agree with them.
I have no doubt they will have had a legal professional check it out.

As for the social networks, haven’t you received bans and the like in the past? Whatever you think the social networks have done, you have broken their use policy.
