An Ohio man was arrested Tuesday for raping a 10-year-old girl who became a central figure in the debate over abortion rights after she reportedly traveled to Indiana to have an abortion when Ohio outlawed the procedure last month.

Arrest records and court records viewed by The Daily Beast confirm that Gerson Fuentes, 27, was arrested Tuesday in Franklin County on a felony charge of raping a person under 13. The Columbus Dispatch, who first reported on his arrest, attended Fuentes’ arraignment in Columbus on Wednesday.

The unidentified girl’s plight became national news when the Indianapolis Star quoted a doctor who said a 10-year-old rape victim, who was six weeks and three days pregnant, had been forced to travel from her home in Columbus to Indiana for an abortion. Her home state had a trigger law that immediately outlawed abortions after six weeks once the Supreme Court overturned Roe v. Wade.

A Columbus Police detective, identified by the Dispatch as Jeffrey Huhn, testified in court Wednesday that the 10-year-old victim was impregnated and had an abortion in Indianapolis.


“The victim went out of state to have a medically terminated abortion,” he said, according to video of the arraignment.

The video showed Fuentes staring blankly during the arraignment and standing with a slouch as a translator relayed the proceedings to him in Spanish.

Court records say the alleged rape occurred on May 12. Detectives said in court that police were made aware of the girl’s pregnancy through a referral filed with the local child services’ branch by her mother on June 22. Eight days later, the girl had the abortion in Indianapolis.

The aborted fetus has since been tested for DNA and entered into evidence, Huhn said, and officials say Fuentes confessed to the rape when he was questioned.

Fuentes’ arrest comes as conservative media claimed the girl’s story was made up for political theater, something parroted by Fox News presenters as recently as Tuesday night—while Fuentes was already in custody.

But those also with egg on their face in light of the horrific crime: the top law-enforcement official in Ohio.

Indeed, state Attorney General Dave Yost spent much of the past week effectively dubbing the story a hoax, suggesting he had heard nothing about any such crime being reported.

“We have a decentralized law enforcement system in Ohio, but we have regular contact with prosecutors and local police and sheriffs,” Yost said in a Fox News segment Monday. “Not a whisper anywhere.”


Yost released a statement Wednesday afternoon that did not address his previous comments.

“My heart aches for the pain suffered by this young child,” he said. “I am grateful for the diligent work of the Columbus Police Department in securing a confession and getting a rapist off the street.”

Dr. Caitlin Bernard, the Indianapolis obstetrician-gynecologist who first described the rape and its aftermath to the Indy Star, previously told The Daily Beast she expected vindication.

“It will all come out in time,” she said via text message on Tuesday.


Court records show Fuentes is being held on a bond of $2 million. The judge said he was considered a flight risk and, given the brutality of the crime, a high bail was necessary to protect the child involved.

So the original story is that on the day abortion was banned in Ohio- June 24- the girl was 6 weeks and 3 days pregnant. This is significant because of the wording of the Ohio law. However this does NOT track with what we know of the timeline and how human pregnancy works.

The weeks of gestation are figured from last menstrual period with the LMP standardized to be 28 days long and ovulation occurring at the midpoint of the cycle. So if a woman is "six weeks pregnant" that means she has actually been pregnant for 4 weeks- the first two weeks are the pre-fertile part of the cycle according to the standardized counting. Now if a woman has PCOS or something, it could have actually been 12 weeks since her last period when she is 6 weeks pregnant. That doesn't matter- the terms of obstetrics are standardized enumeration based on the average. 6 weeks pregnant refers to an embryo that has been developing for 4 weeks.

If she conceived from the rape, she ovulated on or around May 12. Given the short life span of both sperm and eggs, let's put an outside possibility date for conception as May 15. That makes the LMP date as calculated by standard obstetric rubrics May 1.

May 1 LMP makes her 6 weeks 0 days pregnant on June 12. She is 7 weeks 3 days when she tells mom. She is just over 8 weeks when the doctor gets the phone call and nearly 9 weeks at the time of the abortion.

At the very least, the activist doctor was fibbing about the dates of the pregnancy in order to make the story have more dramatic irony ("she missed the cut off by just three days!")

This kid definitely needs to be a ward of the state. The mother is in deep denial and would gladly just shack up with the next child rapist because she needs a mauynn.

Man I don't know... trying to get state to state law enforcement to work together is hard enough. If the feds get involved like they're threatening to then I firmly believe that justice will never be served and we'll never know the whole story. I do wanna say that the Franklin County courthouse is in Columbus, the state's capital. If any shenanigans are gonna happen it's gonna be there. I forget where I saw it, it might have been in this thread, but someone contacted all the major cities in Ohio to talk to their county's CPS and Franklin county was the only one that either didn't or declined to comment. The few things I know about Ohio is that they hate Michigan, if you scream "O-H" they will scream back "I-O", and still live off the one undefeated season OSU had in '12. I don't even know if they have the balls to follow through with a true deep dive into how bad things are with their government agencies. All of this is assuming there isn't any incompetence/corruption/activism in Indiana which would make any investigation moot.

Forgive me, I am extremely black pilled regarding anything involving the government, especially when it involves kids.

And these fucking doctors were willing to put her right back in that environment because police intervention might get them deported. Mercifully they're narcissists that had to make it about abortion for social media clout and accidentally exposed it to public scrutiny.

This happens way too often though. Women just don't naturally register, for whatever retarded reason, how much a threat males non-related to their offspring can be in such situations. They just want to believe the best, that they weren't wrong, and deny abuse even when their children, male or female, tell them of it. They just can't stomach that they somehow did worse than the original father(s) who fucked off for whatever reason to let their children get raped.

Same thing can happen to males to an extent, see the tale of Cinderella. Women aren't too keen on cucking either, but it takes a particular bitch to abuse. Same with men.

Abortionist Caitlin Bernard Under Investigation by Indiana University and Attorney General of Indiana​

Dr. Caitlin Bernard, who alerted the media to the 10-year-old who was raped in Ohio in order to lobby against Republican abortion-restriction laws, is facing at least two investigations for her conduct. Fox News reported that her employer, Indiana University, is investigating her for HIPAA violations for revealing information about her patient to the press.

Fox News’s Aishah Hasnie reported that the IndyStar was rightfully questioned for its incomplete reporting because reporters “cited only an anecdote from the Indiana doc [Caitlin Bernard] who was caring for this girl.” The abortionist, Bernard was also “at an abortion rights rally talking about” the rape, Hasnie said. She went on to report that “[Bernard’s] employer [Indiana U] has filed a HIPAA violation against her for sharing details about the young patient.”

PJ Media reached out to Indiana University to confirm the investigation and get clarification on the violations, but the university did not respond at the time of publishing.

On Wednesday evening, Indiana’s Attorney General, Todd Rokita, went on Primetime with Jesse Watters and announced that he is launching an investigation into Bernard as well. “We have this abortion activist acting as a doctor with a history of failing to report,” he said. “We’re gathering the information, we are gathering the evidence as we speak and we’re going to fight this to the end including looking at her licensure including if she failed to report. In Indiana, it is a crime to potentially not report.”

PJ Media sent multiple requests to Bernard asking for that report, but she refused to respond. We also sent FOIA requests to the Indiana Department of Child Services, the Indiana Health Department, and the Indianapolis Police looking for the mandated report of suspected child abuse that should have been given on July 30 as well as Bernard’s legally required Termination of Pregnancy reports that should have been turned into the authorities within three days of the abortion performed on a minor. None of the FOIA requests have been fulfilled yet.

Bernard was accused in 2018 by Indiana Right to Life of being one of nine doctors who failed to report abortions performed on minor girls. These reports are important to law enforcement because authorities use them to determine if the underaged girls were victims of assault. Without those reports done by abortionists, law enforcement has no way to follow up on possible crimes committed against minors seeking abortions.

PJ Media also sent FOIA requests to the Indiana Attorney General’s office asking for information on any investigation done into Bernard and the other named abortionists in 2018 after the failure-to-report complaints were turned over to that office. No one has responded yet.

This from the 2018 complaint:
Forty-eight consumer complaints have been filed against nine Indiana abortion doctors who have allegedly failed to follow the legal reporting requirements to protect young children from sex abuse. The doctors are: Jeffrey Glazer, Caitlin Bernard, Cassandra Cashman, Carol Dellinger, Mandy Gittler, Kathleen Glover, Martin Haskell, Resad Pasic and Sarah Turner. They are employed at all licensed Indiana abortion facilities: Women’s Med Center in Indianapolis, Clinic for Women in Indianapolis, and Planned Parenthood in Indianapolis, Lafayette, Bloomington and Merrillville. [emphasis mine]
Some of the girls under 16 years old who had abortions that weren’t reported to DCS were as young as 12 and 13. The alleged 48 instances of failure to report occurred since July 1, 2017. The 48 consumer complaints have been filed with Indiana Attorney General Curtis Hill and the Indiana State Department of Health. The Marion, Lake, Tippecanoe and Monroe county prosecutors have also been notified.

We need a their-way, European style right-wing populism in this country. Christian fundamentslismmhas done nothing to stop the Left, and can do nothing to stop the Left. School is concerned she told the world about the abortion, AG is concerned she didn't tell the authorities about the child abuse. She has a history of covering for likely cases of CSA as well.

The difference in priorities doesn't shock me, but I'm still disgusted.

This nonreligious conservatism, as shown by Donald Trump’s success with working-class and Hispanic voters, has broadened the Republican Party’s appeal. Secular conservatives, with public opinion on their side, have been passing multiple state laws banning critical race theory and transgender athletes in women’s sports.
