Crime (Update) Arrest Made in Rape of Ohio 10-Year-Old Who Had to Travel Out of State for Abortion

An Ohio man was arrested Tuesday for raping a 10-year-old girl who became a central figure in the debate over abortion rights after she reportedly traveled to Indiana to have an abortion when Ohio outlawed the procedure last month.

Arrest records and court records viewed by The Daily Beast confirm that Gerson Fuentes, 27, was arrested Tuesday in Franklin County on a felony charge of raping a person under 13. The Columbus Dispatch, who first reported on his arrest, attended Fuentes’ arraignment in Columbus on Wednesday.

The unidentified girl’s plight became national news when the Indianapolis Star quoted a doctor who said a 10-year-old rape victim, who was six weeks and three days pregnant, had been forced to travel from her home in Columbus to Indiana for an abortion. Her home state had a trigger law that immediately outlawed abortions after six weeks once the Supreme Court overturned Roe v. Wade.

A Columbus Police detective, identified by the Dispatch as Jeffrey Huhn, testified in court Wednesday that the 10-year-old victim was impregnated and had an abortion in Indianapolis.


“The victim went out of state to have a medically terminated abortion,” he said, according to video of the arraignment.

The video showed Fuentes staring blankly during the arraignment and standing with a slouch as a translator relayed the proceedings to him in Spanish.

Court records say the alleged rape occurred on May 12. Detectives said in court that police were made aware of the girl’s pregnancy through a referral filed with the local child services’ branch by her mother on June 22. Eight days later, the girl had the abortion in Indianapolis.

The aborted fetus has since been tested for DNA and entered into evidence, Huhn said, and officials say Fuentes confessed to the rape when he was questioned.

Fuentes’ arrest comes as conservative media claimed the girl’s story was made up for political theater, something parroted by Fox News presenters as recently as Tuesday night—while Fuentes was already in custody.

But those also with egg on their face in light of the horrific crime: the top law-enforcement official in Ohio.

Indeed, state Attorney General Dave Yost spent much of the past week effectively dubbing the story a hoax, suggesting he had heard nothing about any such crime being reported.

“We have a decentralized law enforcement system in Ohio, but we have regular contact with prosecutors and local police and sheriffs,” Yost said in a Fox News segment Monday. “Not a whisper anywhere.”


Yost released a statement Wednesday afternoon that did not address his previous comments.

“My heart aches for the pain suffered by this young child,” he said. “I am grateful for the diligent work of the Columbus Police Department in securing a confession and getting a rapist off the street.”

Dr. Caitlin Bernard, the Indianapolis obstetrician-gynecologist who first described the rape and its aftermath to the Indy Star, previously told The Daily Beast she expected vindication.

“It will all come out in time,” she said via text message on Tuesday.


Court records show Fuentes is being held on a bond of $2 million. The judge said he was considered a flight risk and, given the brutality of the crime, a high bail was necessary to protect the child involved.

Dude, in 2020 CPS dealt with 57,963 csa cases. And that's only the cases that are reported to CPS. The fucked up reality is that young girls being raped by mom's boyfriend or a relative is not that uncommon. Not car crash common, sure, but come on man.

Edit: I went back and looked at the report for 2019 just in case the coff fucked with reporting numbers. There were roughly 60,000 csa cases in 2019, so higher than 2020 but not as much as I expected given lockdown.
That’s not really that common considering how many people live in America. And I want the race and states of those numbers lol.

As I stated 2 pages ago, she only filed the report after she went to the media, after people started questioning the lack of a child abuse case, and after giving the rapist a warning (through the news) that people are aware of the rape now.

She knows the report is supposed to help identify cases of child abuse and then she goes off and gives the criminal a chance to get away. She only followed the law in the Jewish sense of the word where she does what she's supposed to do without regard to why she's doing it and is even doing the exact opposite of the intent, but it's OK because loopholes, it wasn't explicitly mentioned.

And for the purposes of the story people were commenting on, published July 1st, it is fair to say that a report filed July 2nd was not filed.

I'm mad at the man who raped the child, but I'm also mad at the people who allowed the man to rape the child and the people who covered for the man who raped the child. Why aren't you mad at his enablers?

By making the fact that people knew he raped the child a big news story before making the report, she gave him a heads up that hey, time to flee. (Good thing he's too dumb and English-illiterate to get the message).

The rationale behind the report isn't some general metric keeping type of thing, it's not a report for all abortions ever. It's a report specifically for abortions for children, with the goal of finding victims of child abuse. She got dinged for not doing these reports properly in 2018, she should understand why the report is important by now even if it was just pointless paperwork to her back then. And yet she still takes actions that could allow a smarter rapist to get away.

Have you never listened to how crime investigations work? The fact that different people know different things is important, and sometimes someone knowing something they shouldn't know yet leads to a key development in the case. And then this woman goes and tells the world and the rapist that the jig is up before she tells the authorities that there might be a victim of child abuse here.

So for anyone who comes across this thread who legitimately thinks this and isn't just a retard shit stirrer, the doctors, the one in Ohio who's still unnamed and Caitlin, are mandated reporters. This means that if they came across a case of child abuse they are required by law to report this to the authorities without delay. They do not get to grandstand in front of the media after performing the procedure and then go to the authorities. If this happened as it's shaping up to be, I use a caveat because there's so much fuckery about, then both doctors are criminals. They have a professional and ethical obligation to report this very obvious case of abuse. They instead chose to spirit the 10 year old across state lines and then brag about it to the media. The fact that a police report couldn't even be produced until a few days ago leads me to believe that maximum fuckery abounds.

Don't forget the part where the report happened a day after the article was released, way after we already said 'why wasn't this reported?'
And then the report went on about how the rapist was 17, so either the doctor is intentionally defending a pedophile or someone lied to her.

And we're more leaning on defending a pedo due to her prior history of shielding retards.

To quantify the need for haste, I'd add that this man was deemed a flight risk worthy of a $2M bond. I know I've been questioning whether or not he's still in custody and if a non-profit posted bond for him, but that's besides the point.

Is a 3-5 day delay reasonable for a $2 Million flight risk? I can maybe understand a 1 day delay if the girl walks in at the end of the day, but I'd hope this is an emergency worth working overtime for. But up to 5 days, a whole business week?

Damn I sure hope the counter starts when the doctor hears of the case, regardless of if/when the abortion actually occurs...

Who the hell knows? It's very unlikely any of the parties involved will ever be deported so it hardly matters at all.

This sort of thing happens in the barrio underworld all the time. it's mostly not reported for a variety of reasons mostly relating to legal status or criminal history. If the full scale of it was ever reported people would be shocked.
 
I'm still questioning whether or not the doctor in Ohio even exists, since afaik the only indication that the victim's mom went to one in Ohio in the first place was Dr. Bernard shitstirring for the media. It's possibly that the victim's mom crossed state lines to begin with, since the mom probably wasn't going for abortion controversy theatre and was just trying to avoid mandated reporters. No idea if the mom had a way of knowing Dr. Bernard has a history of ignoring mandated reporter laws but I don't think I like the implications if she did.
If the Ohio doctor exists then it's possible they didn't see the victim before telling the mom to take her to Indiana, though how the fuck you have someone come to you saying "my ten-year-old daughter is pregnant" and your answer isn't "have you called the cops?" I have no idea. Even if mandated reporter laws only apply when the doctor has physically seen the patients and the Ohio doctor is in the clear, there would still be a clear MORAL failing.
If the Ohio doctor exists then I really dont buy that they'd be ignorant to Ohio law (medically neccesary abortions are legal in Ohio just like literally fucking everywhere else). Telling them to go across the border to Indiana would have definitely been abortion controversy theatre.

ETA: Refusing to deport the shitty mom because she has birthright citizen kids wouldn't be a thing in a just word. She's clearly demonstrated that she's a really fucking unfit mother bc there really is no read on her actions here that isn't her trying to defend/protect someone who repeatedly raped her 10 year old daughter. I haven't seen further claim that there exists a doctor in Ohio, but I have seen claims that the cops in Ohio were aware of the story before Bernard was. Source.
Huhn said Columbus police became aware of the alleged rape through a referral by the Franklin County Children Services on June 22 after the girl's mother reported the pregnancy. The 10-year-old victim traveled to Indianapolis in neighboring Indiana to undergo a medical abortion on June 30, he said.
IIRC by Bernard's timeline she got the referral on Monday the 27th. I'm not sure exactly what FCCS is, if they're more governmental or physician, or if they can have doctors on retainer, but at least they did the right thing and contacted the authorities before they contacted Bernard (who in turn contacted the media before she contacted the authorities).

Now as for why Colombus police did Jack shit and didn't let this bubble up to the AG...

It's still shitty if there's also a doctor in Ohio that didn't do their part, but at least the report was appearently made by someone. It was the police that dropped the ball on the Ohio front.
