No, it's evidence. The finder of fact (like a jury) can just find the evidence not credible.

This is exactly what happened in Depp v. Heard. Heard gave her evidence, but she was such a psycho the jury didn't believe her.

In Vic's (and Depp's) case, their own counterevidence was the same: "them bitches lying"

I remember that.. It was based as fuck and didn't even target any specific political side directly, but OC social media/reddit etc freaked the fuck out. One of the more telling cases.
