Considering the police didn't even bother to question Barb I'd be surprised if this became a felony trial. Literally the only hard evidence would be recordings from Chris himself, which Heilburg could likely argue that nothing he says can be taken seriously.
That the police have never really interviewed Barb means that they were convinced from Day 1 that she suffers from dementia. That he has been in jail for so long is a sign that they have more than enough evidence to believe it's some flavor of really icky elder abuse/statutory rape only mitigated by the tard factor.
 
Chris gets to decide what's in his own best interest, including going to trial. If there is a complete breakdown in attorney client relationship (which is more than just being uncooperative) defense may asked to be removed.
It isn't hard at all for an attorney to beg out of a trial claiming a breakdown, especially when the client is a man wearing a dress who has been examined and declared fit for trial claiming to be married to cartoon characters and insisting he is going to be released and declared innocent any moment.

Yes it could, there have been plenty of cases where communications in and from jail have been used as evidence. Like this one where this dumbass is bragging about his wreckless driving, which contributed to the judge giving him the maximum sentence.
