Based on what I've seen, you can request new counsel but that doesn't mean you'll be granted it.

Also, the judge is going to ask some very tricky, very devious questions about it. Questions like "Have you found a new counsel, then?" And "What is their name?" or "how did you meet this person?"

Not saying this about you specifically, but i think a lot of people in this thread have never been to a relatively small, southern town like Ruckersville before. It has a population of about 1000 people and Greene county in total has under 20k. It doesn't matter that it's a borderline suburb of Charlottesville, the people who choose to live in these areas tend to be highly conservative just like Bob was.

This is Trump country, the majority of people there already believe troons' sole goal is to rape their daughters in gender neutral bathrooms. They then get summoned to a jury and are confronted with Chris, a troon who raped their own mother, admitted to it on a recorded call, and now proclaims themselves to be the second coming of Jesus. Chris also has a large online following and some schizos (like sockness and some current enablers) have bought in as well. They are going to view Chris in the same vein as the antichrist, this is even if somehow they haven't already heard about him because of Hannity or any local buzz.

If this goes all the way to a trial by jury Chris is completely fucked. The only chance he has is if a ton of the evidence is deemed inadmissible, or if he manages to get a UVA SJW as a jury member who absolutely refuses to vote guilty. For this to even happen their government address would have to be their parents home somewhere in Greene county. Virginia also allows full time students to defer Jury Duty if summoned so this makes it even less likely.

SJW types are far less common at ACC/SEC schools like UVA, the majority of students at these schools have republican parents but want to party for a couple years before being forced to grow up and settle down. They probably support weed legalization and don't care much about gay marriage and other soft social issues, but they are still normal college students and are in no way similar to the terminally online types willing give an incestuous rapist a pass because they trooned out.

Chris is not on his first strike. Unless I'm mistaken, the assault on Snyder was wobbled down to a misdemeanor, and I don't believe that the Gamestop macing was a "malicious wounding or malicious felony assault."

If either of those qualified as strikes, he could be eligible for enhanced penalties under VA's two strikes law if they are going for felony rape.

Chris has no strikes. Virginia's three-strikes law only applies to certain violent felonies. Chris has only ever been convicted of misdemeanors.

I don't want to get into rules of evidence because they are complex and even lawyers frequently get them wrong, but evidence of prior bad acts and character evidence is generally inadmissible to prove the charged crime. Unless the defense brings it up first. What you described is exactly that, and opening that door allows the prosecution to use bad acts/character as well. It would be an incredibly risky move for the defense to do that.

The fact that they received a message from Null alerting them would be admissible. The assertions made in it, probably not. Dalton v. Commonwealth blurred the line about text messages/emails being admissible, but that's more for the receipt of messages sent to a present witness by the accused. They'd still want Null to testify.

Null's messages to the police, however, are probably not relevant if they're just about Chris taking money from Barb's account, since he's probably not being charged for that.

They can and will subpoena Bella if it goes to trial and they want to use the recording of the call as evidence. Any emails/texts from Chris will only be admissible if the original headers or phone records are available and can be verified. This is what Dalton v. Commonwealth was about.

Since multiple people had access to Chris' email accounts that would probably cast doubt on them as evidence, though. I don't think that they will use them much, if at all.

I still doubt any of this is relevant though as I still don't think it will go to trial.

Chris currently has zero strikes. None of his convictions count as none of them satisfy the requirements.

Chris is not going before a trial jury, despite the name. It simply means that on august 2nd sometime after 9 am
