It'll be impossible to prove they weren't business expenses now. All he has to say is he was preparing a character to use for the show and eventually decided against it. Then the State has to prove that he didn't which I don't think is possible. And that's assuming they'd give a shit. They don't.
That reason doesn't work. Why would he prepare a character then decide against, then spend $100k+ on it?
