How long can the court require someone to follow the terms of a deferred disposition agreement? Jail isn't changing Chris so he'd just be a nuisance again whenever his term eventually ends if they just sent him to prison. Long term, mandatory supervision would probably be the best option from a public benefit perspective.

I can see the autism defense for offenses that aren't "hands on", but this is bullshit. I understand the three-strikes rule can't apply to Chris due to his varying dispositions in prior violent cases, but he clearly has a track record of not getting the fucking message. Even if it's a longer stint in an inpatient facility before the group home, he needs to be dealt with.
 
Even if he skates this it means punishment is delayed, not escaped. The bill always comes due. Always. One way or another, by way of the law or force of nature or by way of his own stupid hands or some combination therein, it will eventually come and it will not be pretty for Chris. I don't look forward to it and I wont take any joy from hearing about it coming to him. I'll pity him maybe. But that's about it.
 
Heilberg filed when he did because they are working cooperatively. The Court is likely fully aware as well, this has been the plan for awhile, and the motion/hearing will be fairly pro forma.

If sitting in jail for a year was always part of the plan, it's certainly interesting. If deferred disposition on a felony had always been the plan, then they could have skipped a whole ton of languishing in J&DR and just gotten on with it.

Unless Chris was on board with sitting in jail this long, which it sure didn't seem like.

Statutory maximum for probation for a felony in Virginia is five years, I believe. I know that's the amount for a suspended sentence. I'd wager it applies for deferred disposition as well.

Deferred disposition would mean that, if Chris completes his probation, he will actually have never been "punished" at all, in terms of being convicted of a crime, and there will be no de jure sentence.

De facto, of course, Chris will have spent over a year in jail and have to have lived under whatever the conditions of his probation were, so that's effectively punishment.
Effectively a pre-trial diversion.

Which, for those here getting MATI, is something many, many people have been able to access to avoid being prosecuted. True, most did not rape none raped none were known to have raped their mothers, nor do they have existing felony records, but this is where the autism, along with other crucial aspects of Chris's existence, come in.

I just find it odd for autism to garner some kind of special favor considering the diagnosis and definition seems just as nebulous as many other mental disorders that don't get criminals any kind of special treatment. I talk about TCAP a lot around here since it's the logical comparison for a source of dangerous retards, but plenty of those guys who went away for a long time had brain trauma and more than likely other issues. Chris has shown time and again that he knows when he isn't supposed to do something, he just doesn't care.

Being a narcissist isn't autism, it's just highly comorbid because society has recently decided more and more that tards should get their egos stroked throughout childhood and young adulthood.

He won't get away with it. There will most likely be some kind of probation and Chris will fuck it up. Even if he would be let of with time served and nothing else his path still leads to one form of glowie run institution or another. He should just off himself as soon as possible to save everyone further suffering including himself.
 
I guess I should have been ready to accept that Chris would get another extremely light slap on the wrist.

Previously he got away scot-free with: attempted murder, assault with pepper spray, dozens of counts of vandalism, shoplifting, sexually harassing strangers in public dozens of times, sexually assaulting dozens of women, etc., and every time he gets the lightest slap on the wrist imaginable.

I guess raping his own senile disabled mom is no biggie in the eyes of the law.

Every consequence he's ever faced has been a non-consequence. He seems to have fucking HATED being at Western. Therefore, a nice LOONG stay at western (a few years) should set his ass right.

IF the motion is successful, Chris won't be 'convicted' but he will be essentially assigned a government babysitter and terms he has to live under for up to five years. Until we know the terms of the deal, (if there is a deal and this isn't a last second hail mary,) I'm not ready to say he's getting off scot free.

The autism deferral, in my brief, layman's reading on it, seems more intended to give the state flexibility in dealing with people like Chris. I'm guessing a review of the terms of deferral for cases using this motion successfully would show that they tend to be significantly more restrictive than other deferred dispositions falling under other classifications. On one hand, it's lenient because there's no conviction but on the other, it makes clear that they did indeed commit a crime due to their condition and may let the state impose closer supervision than they could otherwise without a conviction.
