You did not find a plot hole. Chris is competent to stand trial, but his lawyer is seeking what amounts to a pretrial diversion program due to his rampant 'tism, which itself comes with a number of conditions that Chris will surely fail to abide by. The two things are completely separate.

OK, hypothetically speaking, let’s say Chris does get off with parole. Where will he even go? He can't go home, not with Barb there, can’t hold down a job, especially now that no one would hire him. From what I heard, there is less oversight there than a regular prison. There are prisoner advocacy groups and lawyers looking to grift with "oppressed" inmates filing lawsuits against the state.

An autism deferred disposition refers to a Virginia law passed in 2020 which could result a deference of further court proceedings with the defendant placed on probation terms set by the court, and could also result in the charge being dismissed

In fairness, if he gets autism probation, the first thing he’s going to do is return to the hoard, violate the order, and get sent to prison. The only scenario that works out favorably for him is that he’s ordered to a group home for criminally insane window lickers. That’s not a favorable outcome in his mind but a group home, nuthouse or wherever they want to stick him is going to be better that what will happen to him in prison (raped and murdered) or being homeless.
