Maybe we are giving the court less credit than we should. Maybe that's exactly their plan. Chris living in prison is heaven for him compared to living on the outside, with all the pressures of life, the looming threat of homelessness, the mean stares of society and the evil weens going after him. They don't want to waste money keeping him safe and sound in prison when they can just set him free and let him rot on his own

You're assuming that the employees of the state of Virginia are as autistic as you and hyper focused on Chris. These people are just doing their job. They are lazy just like everyone else. They are not laying traps for Chris. They just want to finish their work day and go home to their families. They don't give a fuck what happens to Chris and probably never heard of him before he got dragged into their work life.
 
Im honestly really shocked by this. Chris case can set precedent with legality when it involves autism. Who would have thought autism is the Trojan of legality? Hey, rape is a horrendous crime, but your autistic so its morally and ethically fine.
Chris not only raped his mother, but if this gets him out, he raped justice as well. Regarding of what Barb did or didn't do, she has servere case of dementia and Chris knew that.
The only thing I could think that led to this is the grand jury only saw a female cpu trans lesbian goddess blue heart with a female soul rather then the monster he actually is.
Barb at the end of the day got raped by her son, Justice will not be served, most likely Chris will try to see Barb again and this time it might be to late. Shame on the Virginia Court system for this gross violation.

I would think that autism would be mentioned as a mitigation at the penalty phase, not at the beginning where the question is,"Iis there evidence to show that this person committed this crime?" How can you argue, "It isn't incest for this man to rape his mother because AUTISM."?

I tend to think this is just a tactic on Heilberg's part to make the prosecution think it might be messy to go after Chris too hard. Perhaps he's hoping raising the Aut Card will get a better plea deal.

I have a hard time believing that even if he gets away with it he won't be put in care, or at the very least a group home.

Ok, I'm starting to see what probably happened:

When Heilberg made the motion for the autism defense (8/5), they must have put off presenting the case to the grand jury, instead opting to continue until the motion is accepted or not. If it was a flat out grand jury refusal, I doubt they would have continued. And Heilberg probably has the hospital paperwork to back it up.
I think you're absolutely right. Heilberg would have never filed that motion up front if there was any chance Chris would not be indicted....after all it's kind of odd to ask for deferred disposition if you're not guilty. He basically pled guilty up front and asked for leniency in sentencing.

This following motion may be to enter the hospital evaluation paperwork into the record for this purpose.

Maybe he finally made Chris understand that there is no chance in hell he will get off scot-free, no chance in hell he will go back to 14 BC and no chance in hell he will see Barbara again and this is the best possible outcome he can hope for after losing more than a year of his life in jail and probably every possession he owns. Guess we'll never know for sure but something must have clicked.

Coming out of this with the tugboat intact and a felony-free record is simply as good as it could possibly get, every other outcome would be far worse. Shoot, more than a few inmates serving hard time in the VDC would probably give away an organ or two for a second chance like that.

You always could do that. The new statutes allow it to be introduced in the trial as a mitigating factor, with an option for deferred disposition.

...except this isn't really anything new, they basically undo one from 1980 that banned the use of mental illness as a defense.

He probably also thinks his deferred sentencing is a get out of jail free card like the Therapeutic Docket. Watch the dumb ass show up at 14BC the first day he's out and get popped.
 
Given that this apparently only became a thing in 2020, if Glen Youngkin's staff don't pick up on this "autism disorder deferral" claptrap and use Chris-Chan as the poster (man)child for an attack ad portraying Virginia Dems as soft on crime in the inevitable re-election campaign, then they're probably not competent to stand trial themselves.

It’s hard to believe, but at the same time, consider the amount of mentally ill homeless with arrest records out there. It happens all the time. Chris being a prime contender for slipping through the cracks as he has nobody advocating for him and is essentially without any real family or friends anymore.
