If Virginia legitimately believes that austists are so incapable of parsing right from wrong that they can't be held accountable for anything, then upon diagnosis they should immediately be permanently locked away for the benefit of society as a whole.
It will be a cold day in Hell Cwcville before the state government of Virginia finally decrees not participating in state-mandated autistic kicking constitutes a finable offense. But then again, the law being passed is unlikely, as the only true and honest autistic is Chris.
 
Yes. An autism deferral is also not available if the crime is of a sexual nature.

There's that thing too about consent, Ralph didn't have consent to post revenge porn but was somehow able to secure deferred adjudication so Virginia seems incredibly lenient when dealing with retards who get themselves in trouble committing sexual crime.

Incest is not one of the sex crimes listed as ineligible, as it is not in Article 7 of crimes against the person.

You are also ineligible if it is your second offense under a two strikes law. Incest with your mother is not one of those, though oral/anal with your mother is -- but it must be a second offense.

So the autism deferral *IS* available in Chris' case.
 
So as someone who is a tard wrangler at a group home, and a follower of christory since about 2011, allow me to explain some of the other things he may get annoyed with based on what I have seen working several facilities.

Limited to no internet access: No ability to watch the shows he wants or if he can, only for limited intervals (strictly enforced), no porn (also strictly enforced), and heavily restricted access to social media (usually only if you behave, although all facilities are different).

The amount of "slow in the mind" people he will be around: lets be honest here, Chris has been vocal in the past that he views himself as better than other people with autism (and maybe down syndrome). Imagine Chris in a home where he had to deal with individuals with down syndrome, autism, schizophrenia, and various other mental or developmental (there is a difference based on diagnosis) disabilities. Now imagine him living there for up to 5 years. It was posted in his jail letter that he may have tried to perform an exorcism on someone while at the mental hospital under heavier guard, now picture that at a group home which can have as few as one staff to ten residents.

Roommates: the facility I currently work at sleeps two residents to a room. Just picture Chris getting put with someone with lower functioning autism than him, who doesn't buy into the merge, or just rages even more than Chris does, or, well, any other number of reasons.

Food: at my facility, they may get some type of fast food (or any type of restaurant food) once a month. The rest is government approved sodexo/sysco/whoever the lowest bidder is, food that I would consider worse than what I got in all the MREs I've eaten (vomlet excluded). Although, knowing Chris, he may actually appreciate the TVP, as its mostly soy, so this could potentially be a plus.

Communication: while I am not sure what group homes are like in Virginia, where I work, communication is heavily restricted. Monitored calls to prevent asking for things that they can't have, monitored outgoing mail (there's a story to why that happened), as well as incoming mail so that no contraband gets in. Obviously this would prevent Chris from begging as much (although to quote Jeff Goldblum "life finds a way") if the screen them, but I have no way of knowing if they would actually screen his letters at whatever facility he goes to, however, if any of his letters are brought up in trial, they might.

Can you estimate how much of his own stuff he’d be able to keep/display? Could he use his own retarded pony sheets?

Are there hygiene standards?

Would he have to do chores?

Question, due to the failure to indict mean right now? Is it now a felony or still a misdemeanor? Because I'm confused as to the grounds for his continued detention past the maximum length of the possible misdemeanor sentence.

Even if Chris gets autism card, Chris isn't returning to his "normal" life.

I could see banning porn at school, work or in prison, but how does that work in a living facility? I don't think it's legal for your landlord to put a parental block on accessing porn from your own home, or confiscate a playboy he finds on his daily porn patrols on his residents

Obviously living in a tard home is not the same as renting from a private person.

There is also medial / mental health arguments that can be made i.e. look this guy can't understand the concept of later so when exposed to porn they are liable to drop there trousers in public and start fettling there giggle stick so we don't allow porn to prevent a issue... etc

I'm no expert on this, but it's my understanding (from reading the posts of other, more informed people like Pointless Sperg) that Chris's current charge is a "wobbler"; such charges are considered felonies by default, but can be tried as either a felony or a misdemeanor. Since Chris's case has moved from J&DR court to circuit court, we can presume his charge will be tried as a felony; the max sentence for felony incest is 10 years, so I don't think they should have any issues with continuing to hold him.
Like I said, I'm no expert on the law, so I might be wrong about this.

Do they also heavily-medicate most of the residents to keep them constantly sedated and easier to control?

Do residents technically have the right to leave, or are they pretty much inmates under a different designation?

If he goes to such a facility, would it not be for life?
 
Chris is adaptable though.
Chris reminds me of the conclusion of an episode of King of the Hill, where Cotton and Hank reflect on the fact that Bobby couldn't be broken in Cotton's military school/camp:

Chris's whole life has been one disaster after another, and he just keeps on going, almost unfazed beyond a tantrum or crashing into slumber for a bit. He's lost multiple (fake) girlfriends, was cut off from whatever "real friends" he knew, had his house burned down, got kicked out of a convention, tormented publicly for over a decade, had multiple court cases, been banned from numerous places that were a big part of his life and has now spent a year in jail. Many thought that being removed from the comfort of home and all of his toys/games would break him, but he just sits there in his cell, cobbling together what creature comforts are available to him, living in his retarded fantasy land. Even when faced with being sent to a group home, where he would be living shoulder-to-shoulder with a bunch of slow-in-the-minds that he vocally hates, he seems just fine.

He is essentially impervious to any form of punishment or consequence. Unfortunately, this is also why he will never be more than what he is and always has been, he has no reason to change or grow.
