Of course ultimately he's going to have to be worried for a different reason. Since the site data is still there, I don't think so.
Destroying evidence would be like deleting a hard disk by hulk smashing it because you knew it was illegal.
Cloudflare would argue that they only kept IP or other logs (packet data on DDOS maybe like bad ICMP requests) and did not look at the information (posts) as a carrier (kind of like a telecom company I think).
