The confusing part is the "Track Assignment Notice." Perhaps the clock hasn't started ticking if the case hasn't been assigned to a judge or courtroom yet.

It might be moot anyways, if the court simply accepts your reply as if you were waving service. They apparently haven't dismissed it.

Meanwhile, this Vikki decision is also taking a long ass time. What is it with slow-ass judges in Texas (amirite @5t3n0g0ph3r)?

There needs to be a rule in Texas courts that if a case languishes on the docket without activity longer than a year, then the judge gets poked with cattle prods until they make a ruling.

What are James E. Kinkeade's past rulings like in regards to defamation cases?
I think they would serve as a bit of an insight into how he interprets the law as well as the lens he views this case.

With respect to which defendant? They're at radically different points.

I mean, it may interest you to know that in Bonds v. BancTec Inc., Kinkaeade threw out a case because Fed. R. Civ. P. 4(m) wasn't adhered to. Rule 4 isn't limited to defamation cases, and that's the rule that Vikki heavily leans on as she seeks the default judgement to be reversed. The defendant in that case exceeded the 90 day time limit for service. As did Preston. You'd think he should make the same ruling here, and I hope he does. The sticking point might be that the Magistrate Judge could hit Kinkeade was some weird recommendation.

I honestly dunno if it's worth analyzing Dean's prospects until he gets legal council. My concern with him is that he's much further along in the process (no thanks in part to his own ignorance, and in part to @Spectre_06 wanting to be an e-celebrity and pretend lawyer), and there's a good chance it doesn't matter how Kinkeade has ruled in the past if Dean keeps screwing up and doesn't make sound legal arguments.

Whatever Dean does, I strongly recommend he doesn't hire this firm in Texas. I've heard rumors they suck ass at litigating defamation cases.

@FROG's attorneys filed a surreply on 8/22/22, however the decision on whether to dismiss, which was supposed to come down on the 26th, hasn't happened yet. A surreply is usually the last thing before a decision is made, so it should hopefully be soon.

Sorry to steal your thunder @I'm not a Robot, but you seem to be MIA at the moment.

There's also a decision pending on whether to allow Preston's attorneys to represent him in this case Pro Hac Vice. Which means one or more of them are not licensed to practice in New Jersey. Oddly, that was supposed to be decided last month too. The top item is the filing I reproduced here, and that's where the record stands as of 9/1/22.

EDIT TO ADD: I checked PACER while at work, and there is no update in Vikki or Dean's case which is still going on in the ND of Texas. The last thing was the Vikki's surreply to vacate the default judgement that she filed back on 5/27.

Texas judges (both state and federal) drag their asses again. 🙄

Speaking of which, any news about The Fein Law Firm's lawsuit against @PocketJacks?
I haven't heard anything about that unless they settled.
EDIT: Non-Jury Trial is scheduled for December 13th
There was another administrative error. The hearing on the motion to enforce arbitration that was scheduled for April 22nd, then May 12th, is now scheduled for September 29th.
