It probably won't be. It's sometimes amusing to read the cases of people who actually do get disbarred because they nearly always involve years of absolutely horrific behavior, but unlike the complaints against Nick, it would at least not be patently frivolous.
That said, what happens during trial can really change what kind of jury instructions you want, like whether or not you want a lesser-included instruction (i.e. give the jury a chance to convict the defendant of a lesser offense that only includes part of the greater offense).
It's often a go for broke decision not to give the jury a choice as to whether to convict of a big crime (like murder) instead of a lesser crime.
