Inactive Nick Bate / Nickalaus B. Stoutzenberger - (Thread 3: JUDGEMENT DAY)

Does anyone know if it'd be possible for me to contact the prison and request that he not write to me anymore?

You'll probably need to file an order of protection/no contact, or ask that to be added to his sentencing.
Nick should not be contacting you.
I'd even suggest calling the police and telling them what's up, then ask them how to proceed. They're good at making sure sick fucks get what's coming to them.

Generally things like protective orders require that the target of the order is capable of controlling himself. Nick obviously isn't. But he's in the custody of people who can screen his letters with or without his consent.

Also, very soon, he'll be in the custody of different people. So his new prison, where he'll be spending the next very long chunk of his life, are probably the ones who need the full context on this, so they know to make sure to screen his letters for the foreseeable future as even while awaiting sentencing, this toxic piece of shit has been harassing his victims.

He is that stupid and that vicious.

But of course, the DA NEEDS this unopened letter and the context to be able to nail this fucker to the wall at sentencing with rock solid proof that this garbage, this filth, can't stop committing crimes even while facing sentencing.

Please make sure the DA gets this letter, preferably UNOPENED, and knows the context, that you are another of Nick's victims who has done everything possible to make sure he knows you want no contact from him at all, but that he has harassed you for years anyway.

YES TO ALL THIS!

How the fuck did he even remember the correct address? I can barely remember family members' addresses and they've lived there for years.

Or was he allowed a phone book or something??

That also is good evidence that he's a completely obsessed stalker.

One of the most important sentencing factors is whether the offender is likely to reoffend. The fact that they somehow managed to reoffend while already behind bars is super strong evidence that they are very likely to reoffend. After all, they already have.

This is also very relevant to one of the specific factors the judge cited, i.e. is this guy a predator?

He obviously is and this just underscores it.

Reoffend? Did he commit a crime by contacting her? Was there a restraining order? I ask because I just can just see the defense spinning this as nothing. Depending on whats in the letter of course.

Harassment is a crime. When someone asks you to stop contacting them and you do so directly, such as BY SENDING THEM A LETTER THROUGH THE FEDERAL POSTAL SERVICE, you are harassing them.

And yes, Nick was told by Anna herself, by people who knew her, and at least once by actual cops to leave her the fuck alone. For YEARS.

I see. If the cops were involved then yeah theres no spinning that. I always though you had to have a restraining order for the cops to get off their asses and do anything though. Do you think the content of the letter will make any difference at sentencing or will just the fact that he sent her the letter doom him from the start?

I dunno. That's why the DA should be the first person to see it.

Yeah, I guess sending the letter to the DA makes sense. Don't read it yourself, tho.

i thought he has like an order that prevents him from entering the whole state of california? unless i'm mistaken. though, i guess it technically isn't him entering, it's his letter, but still.

That's why I did the slash NCO! I'm not sure how that works since the recipient is in another state.
I imagine the penalties are much harsher because of that, though.

-edit-
i changed country to state because dumb

If that's true then it's news to me, I always assumed that the only thing the police really did was told Nick to knock it off and stop harassing Arcani. Obviously it had minimal effect on him but it was a strong enough warning to encourage him to stop referring to her by name at the very least.

Regardless of having a restraining order of sorts, Nick sending a letter to someone who he was repeatedly told not to harass does not reflect well on him. It might not get him in as much trouble if it was an apology of some kind, but this is Nick, if anything I could imagine a letter to Arcani after almost a year of being locked up being worse than something he would normally send. This is going to do him no favours.

I hope @Ancani tells us what she did with the letter, but I'd understand if she just sent it to the Lancaster county DA with a letter explaining who she was, and how she was connected to Nick, and his history of harassment of her. She may just want to be done with the whole thing.

Sending it to the DA unopened is the best possible thing she could do.
