Money Barb Sued by Discover Bank

These two will never learn, won't they? Instead of trying to save money, they keep piling up debt after debt *sigh* Oh well, the hoard hungers and has to be fed.

I wonder why Chris hasn't raged about ColdHearted and Mean Discovery Bank? Is he too busy to play PS4 to care about Barb's hearing?

AFAIK debts are not passed on to children. So unless Chris' name is on something, all Barb's debt goes with her.

So, a bank (or its legal team) really has no problem telling someone like Chris that they have to pay. Normal people will say "No I don't!" and then the bank is like "oh yeah, lol you don't. but grrrr we wish you didn't know that!". Chris isn't like that, he doesn't think like a normal person. He'd just bitch about how it's not fair and then pay minimum payments.

Then there's also the fact that if Chris is listed on those debts in any way, they could try and hold him responsible. If he's on the card she uses, if he's on the loan, if he's put on anything that accrued that debt (car for example), they could try and make him liable.

The lawsuit seems to be just for Barb, so it's not like Chris was a co-defendant or anything....so for now, I'd say Chris is in the clear. Chris could help pay with amiibo money, but I kinda think Barb's just gonna have to sell some of the hoard.

One step in the process of suing someone is putting them on notice. The bank has their house address, telephone number, etc; there's no way that message didn't get to them unless they have refused to answer the door and have thrown out every single letter they've received.

Well, the bank is required to protect two moths worth of Social Security direct deposits, but anything else that she might have in her bank account is fair game, no matter what the original source of income. Assuming that she doesn't have any savings to speak of (which is a pretty safe assumption), the creditor won't be able to touch any of her Social Security money. Regardless, as her Social Security deposits come in each month, the creditor won't be able to touch any of those either.

"If a collector tries to garnish money in your account, your bank must look at your account history to see if you received any Social Security or VA benefits by direct deposit in the last 2 months. The bank must protect 2 months’ worth of benefits from garnishment and let you use that money. If your account has more than 2 months’ worth of benefits, your bank can freeze the extra money."
 
I think it's pretty much guaranteed she has been ignoring payments for some months.

Also, by the time legal action is initiated your account will already have been closed. A lot of people get pissy about making payments on something which has no further utility to them and don't regard paying off those debts as a priority. Credit providers know this and will often balance chase first so this has been building up for a while.

The company I worked for had a hardship programme. If you complied with all of its requirements, there wasn't even a ding on your credit record and your account was reactivated at the end (it was effectively suspended for the duration of the programme).

According to the site they were served by posted, which I'm led to believe means it was posted to their front door.
 
Part of me--JUST A PART OF ME--thinks Barb won't show up for that hearing. Not because she's unaware of it, but because she has a deep-seated resentment towards the legal community, stemming all the way from Lil' Chris and the screaming incident in grade school, to the boy scouts, to the hit-and-run, to the macing.

Just have to wait and see.
 
Damn, I feel sorry for Chris right now. That's what I would have said, if Chris actually gave a damn about his finances.
But that's the hilarious and sad thing about it--Chris IS fulfilling his financial obligations (most of the time); it's Barb who doesn't seem to give a fuck and who's dragging both of them down.
