A specific example doesn't -necessarily- require claiming deliberate fraud, can definitely be argued to have hurt the process. The remedy is simple, redo the election in that state. It -does- have precedent.

Addition: To expand upon this. One of, if not the, biggest reasons the Trump lawsuits (Either by him or by third parties) failed was claiming it was fraud. As soon as you claim that you raise your own evidentiary standard. You now must prove that the event seen was done maliciously. The best thing these lawsuits can do is to never once claim fraud. Instead claim it is a defect of the system, an improper following of procedure, something demonstrable but not malicious.

Makes it a lot harder to dismiss.

The Dems will almost certainly overreach themselves, and instead of focusing on smaller changes where compromise is achievable on things like improving the immigration adjudication and asylum process, they'll insist on trying to ram through a huge and undigestible lump of shit.

The Republicans also remember (or should) what happened with the "one-time" amnesty under Reagan, where the Dems promised to exchange amnesty for actually fixing border security and implementing stricter deportation and worker requirements for companies. Guess what never happened after they got their amnesty? Lots more illegals came, though.

On the Dem side, they're reaching on this and they don't really have the capital to force it through. There isn't much they can do with waverers like Joe Manchin and a few others like Henry Cuellar, and there's nothing they can promise them that will be believed. They really fucked themselves by screwing Manchin. The Dems lost the House, so it won't pass there, and the Dems don't have the 60 votes in the Senate to move past the filibuster there.

They have no credibility on immigration in particular because, under their watch, the system has completely fallen into chaos and they've made no attempt to fix a single aspect of it. You can argue that it's deliberate, and I think that's mostly true, but it also shows their fundamental lack of competence and their lack of solutions. If they had any good ideas, they'd be putting them out there, not proposing another huge shift in policy without having a clear mandate.
