Lawyers for Amber McLaughlin, 49, asked Missouri Gov. Mike Parson to spare her this week. McLaughlin was convicted of killing 45-year-old Beverly Guenther in 2003.

COLUMBIA, Mo. — The first openly transgender woman set to be executed in the U.S. is asking Missouri’s governor for mercy, citing mental health issues.

Lawyers for Amber McLaughlin, now 49, on Monday asked Republican Gov. Mike Parson to spare her.

McLaughlin was convicted of killing 45-year-old Beverly Guenther on Nov. 20, 2003. Guenther was raped and stabbed to death in St. Louis County.

There is no known case of an openly transgender inmate being executed in the U.S. before, according to the anti-execution Death Penalty Information Center.

“It’s wrong when anyone’s executed regardless, but I hope that this is a first that doesn’t occur,” federal public defender Larry Komp said. “Amber has shown great courage in embracing who she is as a transgender woman in spite of the potential for people reacting with hate, so I admire her display of courage.”

McLaughlin’s lawyers cited her traumatic childhood and mental health issues, which the jury never heard, in the clemency petition. A foster parent rubbed feces in her face when she was a toddler and her adoptive father tased her, according to the letter to Parson. She tried to kill herself multiple times, both as a child and as an adult.

Parson spokeswoman Kelli Jones said the Governor’s Office is reviewing her request for mercy.

“These are not decisions that the Governor takes lightly,” Jones said in an email.

Komp said McLaughlin’s lawyers are scheduled to meet with Parson on Tuesday.

A judge sentenced McLaughlin to death after a jury was unable to decide on death or life in prison without parole.

A federal judge in St. Louis ordered a new sentencing hearing in 2016, citing concerns about the effectiveness of McLaughlin’s trial lawyers and faulty jury instructions. But in 2021, a federal appeals court panel reinstated the death penalty.

McLaughlin’s lawyers also listed the jury’s indecision and McLaughlin’s remorse as reasons Parson should spare her life.

Missouri has only executed one woman before, state Corrections Department spokeswoman Karen Pojmann said in an email.

McLaughlin’s lawyers said she previously was rooming with another transgender woman but now is living in isolation leading up to her scheduled execution date.

Pojmann said 9% of Missouri’s prison population is female, and all capital punishment inmates are imprisoned at Potosi Correctional Center.

“It is extremely unusual for a woman to commit a capital offense, such as a brutal murder, and even more unusual for a woman to, as was the case with McLaughlin, rape and murder a woman,” Pojmann said.
Missouri executed two men this year. Kevin Johnson, a 37 year old who was convicted of ambushing and killing a St. Louis area police officer he blamed in the death of his younger brother, was put to death last month. Carmen Deck died by injection in May for killing James and Zelma Long during a robbery at their home in De Soto, Missouri, in 1996.
 
Would the state of Missouri rather validate a murderer's gender identity and use it to justify why they should be spared the death sentence...
Could you imagine how this would go down if McLaughlin was pardoned because of a claimed trans identity?

The needle. If you google "guatemala lethal injection footage" you will see what it looks like. Dead Man Walking was over the top dramatic-it is actually beyond boring. Guatemala at least put it on national television.

Interesting how this is going down-more civilized states just commute to LWOP, the former Confederacy with it's beautiful history of slavery,lynchings, trails of tears for Indians (see OK) tries to kill as much as possible.

Has the transition been surgical, like removal of the dong? If so, why not commute "her" sentence to LWOP and put "her" into a women's prison, then film "Orange is the new Vag" and stream it for our amusement?

Why does it take so long to execute people? This was nearly 20 years ago. WTF? How is living for 20 more years and possibly more a real death sentence? Just do it within a 3 year appeals period or don't. In obvious cases like Darrell Brooks, I would be fine with a public firing squad because the evidence is beyond a shadow of a doubt. Again, if we are to have the death penalty and it is supposedly to deter crime, why do we never see it carried out as graphically as possible so we as a people so we can learn from it?
 
I understand why a lot of people don't support the death penalty, but I've always seen it as a surefire way for the unredeemable criminals like this guy to never hurt anyone ever again. People like this will always try to weasel their way out of punishment, and reoffend if they get the chance. So don't give them the chance. I would also like to extend some empathy for the fellow prisoners and guards from dealing with a low-effort troon for the rest of his pathetic life.

Missouri doesn't afraid of anything like this, & it'll be one of the last & most militant holdouts against being bullied into any substantive action when the argument involves troons/mental illness.

Parsons also hates literally fucking everyone, so this creature never had a prayer to begin with. But since its lawyers are bringing to the forefront that this child rapist is also a troon, all they've done is enable Parsons to rip a subtextual boner when he tells this dude to get fucked. This meeting on Tuesday is nothing but a formality that he was forced into by his own counsel to help insulate from giving possible traction to any future litigation.

I agree, Parsons claims to have "a personal relationship with Jesus". Thinking that the creator of the universe takes specific interest in you is full blown narcissism. Unfortunately,by virtue of Evangelical Christianity it's a widespread mental disease in the South. The last thing you can expect from people thinking God is talking to them is empathy (my own experience-the more Puritan the less willingness to support i.e social issues)
 
The article neglects to mention McLaughlin is listed on the Missouri Sex Offender Registry and was at one point incarcerated for the 1992 sexual assault of a 14-year-old girl. Never saw that one coming, right?
Thanks, when i read "you'll never guess the crime" i immediately thought it must at least be linked to kid diddling and was surprised when it wasn't after reading the article. Alas, the leopard can't change its spots, much like the troon can't change its gender.

I could definitely live with this provided they spend the rest of their lives in prison and are made to submit to the work of one of these gender affirming butchers.
 
It’s hypocritical how some people oppose the death penalty but then have no problem with assisted suicide.

Personally I’m not against adults self castrating, just kids. My problem with gender affirming care is they don’t fully disclose all the potential complications, especially to children.
