The Rules state that if the Supreme Court of Texas thinks that the appellate court did nothing wrong they must instead refuse the petition

But, based on the distinction between SCOTX denying the petition vs refusing it, he didn't necessarily lose because of that... even if SCOTX considered that the trial court interpreted the law wrongly it would nevertheless not affect the case being ultimately dismissed.
