You would have to be literally braindead-level retarded to get yourself sued by a lolcow.
braindead retarded and also a malicious attention whore on top of that
because lets be real, personally contacting and actively fucking with cows is a step beyond the regular kf business (shitposting about them on an obscure internet forum)

That being, his obviously retarded demands + his clear bad faith. In the lawsuit, he very clearly states Zell only paid 1$, and has his own finances and channel membership history in the attachments, yet demands 150k $.
$150k is the potential statutory damages for a single instance of copyright infringement. You don't actually have to prove damages to get that.

I literally mentioned a few pages back that Zell is being sued over Copyright infringement. That is Acers "end goal", to win on that and get tons of money from it (lol).
One could argue he also has a victory of sorts over Sid as well. He hasn't released a video in five months. There's been gaming news to report on, he just hasn't. There hasn't been any real growth on the channel since.

My point was he and everyone else knows that the lolsuit won't go anywhere, it will be thrown out of court. Zee did not monetize anything, he posted something avaible to public.

This was pants on head retarded move on his part. Since you know this was thrown out before for same exact reason.

Less of victory and more of coincidence. Sid's health has been on steady decline for a past several years or so, similarly to Metokur, and for a long while doctors kept saying that they can't figure out what's wrong with him.
Fortunately for Sid, a doctor arrived with good news, so he got to stop being defeated and went off the internet to fix his other irl problems, without dispersing attention on the internet squabbles (I hope). Last twitter activity was like... november?
There hasn't been any real growth on the channel since.
Kinda hard to have growth when your "visit to hospital was supposed to be the last one".

Anyway, I don't think I overreacted, but given that you apparently did try to make it all work (even if I think you could have done much better), I do fully apologize for any offense you might have taken
I haven't taken any offense, it was moronic of me to forget to include the line about doing the work even if at the time I had no proof of actually having it done.
Still, I feel like having a picture of a channel/upload is good to have alongside the video itself, especially consideing that Acerthorn is known to be deleting things. I understand it was impossible to tell at the time that it was supposed to be alongside, not as the only available option.

he posted something avaible to public.
Avaible for 1 dollar, if no pay, not avaible.

Lots of people still made content when sick. Hell, look at Totalbiscuit and Metokur. They made content until the final year of their lives and stepped away when they just didn't have the energy to do it anymore and to slip away quietly.

Look how well that ended for Akilah Hughes.
Akilah sued Sargon because he cut clips out of her videos to contradict her. The judge found that selecting the clips was sufficent to qualify as fair use. In this case zell re-uploaded a stream that was behind a paywall verbatim. It's unlikely a judge will find in his favor unless the fat faggot manages to self sabotage his case yet again.

He also (according to Mr. Stabby so this may be bullshit) actually insanely dumbly signed an agreement that he wasn't the co-author of the material so had no right to redistribute it (other than the fair use exception). If that's true, he's kind of fucked actually if the case is prosecuted remotely competently (also a big if).

Making an argument that duplicating the entirety of something is fair use is not a situation you want to be a defendant in.

I'll note that if this statement is true, he effectively transferred any copyright ownership he had in the stream by the only means you can do that, i.e., in a written agreement. Otherwise he would have been co-author and just as entitled as Stabby to redistribute or do anything else he wanted with his own interest in it, including selling that to someone else.

I hope Stabby is lying about that because it requires nearly insane levels of stupidity to end up in this situation.

The alphabet companies default stance when receiving legal requests for information is to just give it.
Wouldn't such a policy, if applied worldwide, risk huge fines as a result of the EU's data-protection laws (GDPR)?

Could you protect yourself by setting your Google/social media account's location to some Eurofag country?

I can only comment on alphabets movements in the United States of America, however the GDPR will probably have a clause which doesn’t protect users if their data is requested via legal means lawsuit/police investigation.
GDPR isn’t going to protect you like living in the Cayman Islands. It’s to protect you from anonymous data searches from companies and data retention.

Again I am not 100% sure but i’ve never heard of a euro fag saying that the GDPR protected them from being arrested for calling someone a NIGGER online.

There is in fact a line in article 6 of the GDPR that says your data can be processed if it is required to meet a legal obligation. Given that processing is very broadly defined and includes "making available". I would assume this is the section that allows them to hand over data for valid court orders.

Processing shall be lawful only if and to the extent that at least one of the following applies:
the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
processing is necessary for compliance with a legal obligation to which the controller is subject;
processing is necessary in order to protect the vital interests of the data subject or of another natural person;
processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

Crap, thats messed up.

Yup. That just sounds crazy. I just dropped by here cause of the announcement, nearly afraid to post anything cause faggots scream "late" if you're just catching up to some shit hitting the fan but if you dont mind me asking, was this Zell guy somehow doing streams with this lolcow and then they had a falling out or what?

There's no way he could be so dumb to do an "interview" with the lolcow for lulz and with the intention to distribute it, only to sign an agreement not to. Right?

And even then there are a hundred ways to actively fuck with someone that don't involve handing them your own ass on a silver plate, tied up with a pretty red ribbon. It's stupid beyond measure. On the level of prank-calling the police station from your home landline because you're 8 years old and don't have the slightest goddamn clue how anything actually works.

That would require the following to prove
David's actual viewership, income from these sources and how a single person could cause 150k in damages.

David is pulling numbers out of his ass, any competent defense lawyer would instantly notice this bullshit in court if it even gets there.

This is a SLAPP suit at the very best
