The contract drafter assumes the risk in consideration of the return, usually with some clauses thrown in for non-performance, sure, but it would be unusual to split the risk if you aren't going to be splitting the revenue.
Yep. With the contract as written, the DW has a guaranteed return while offloading most of the risk onto Crowder.

The idea that Daily Wire are evil for putting clauses in the contract that allow for them to claw back payments in certain circumstances is insane. Look at Nick. He signed a deal which is smaller by probably two orders of magnitude, and within weeks of the ink drying he was chatting about taking MDMA, considering taking poppers, bragging about going to an underwear party at the gay bar, sticking bottles up his ass, and more. He's said that he's contracted for 3 exclusive streams a week. "An hour" typically means more like 1.5 hours, but it varies. Particularly if he's got a lot of YouTube superchats to read, since he tries to finish them on YouTube.

As for the ongoing stream, he just ended it on YT about 5 minutes ago.
 
Around 12 minutes in to the show last night, he read a Superchat about a missing 5 year old. He followed this with, "If you are a praying person, please pray for the safety of that little boy." For some reason, this really jumped out at me. He used to tell people that he would personally be praying for the subject of the Superchat. I have never heard him delegate that sort of thing to the audience. I don't know, just an observation.

He understands this and now thinks the only reason they would try to recruit him is to try to limit the kinds of stuff he can say or to eliminate competition or whatever. He was able to be "insulted" by the original contract because he doesn't need it and can walk away just to make a point. Maybe it didn't need to turn into a huge slapfight, but it suits both of them to have this be their position. DW can look like sophisticated experts actually getting things done and Crowder can look like a principled upstart who can succeed without compromising. Win-win.

I get some of the DW contract points, like, yeah, you can't just rest on assumptions and good vibes in business. Risk does need to be shared. But demonetization is already so arbitrary that it seems sensible for a creator to want to be supported by the company instead of penalized for it. That would be more in line with what conservatives have been saying about Big Tech for years, so maybe they should be creating in-house ways of dealing with that instead of tying their fortunes to malicious flagging.
