Appeals court oral argument isn't about smackdowns it is about the most boring shit you can possibly imagine. It's not about showing up in a flashy suit and acting like Saul Goodman.
That's the only argument for why he should be allowed to raise on appeal issues he didn't plead in his complaint adequately. He didn't even plead it inartfully, he just entirely neglected to state the claim at all, missing critical elements. The court can't just write it in for him.
I really hope "my client is the Dunning-Kruger effect personified" doesn't get adopted as precedent.
He has gone dark in the past when he's suffered a setback (or something he perceives as a setback). The speculation is that he's nursing a narcissistic injury. He probably thought he was the equal to his lawyers until they essentially stated he's a bumbling idiot who has no idea what he's doing and should be cut some slack because of that.
