The Mexican migrant shot dead by an Arizona rancher after crossing the border illegally and running onto his land can be pictured today for the first time as his family calls for 'justice' in his death.

Gabriel Cuen-Butimea, 48, was shot on Monday January 30th by 73-year-old rancher George Alan Kelly, after crossing onto Kelly's land in Kino Springs, a remote area of Arizona just 1.5miles from the border.

He was unarmed and was shot once - dying on the property.

Kelly, who friends say has had trouble with other migrants passing through his land, remains in custody in Arizona on a $1million bond, awaiting his next court appearance on a single murder charge.

He pleaded with a judge to lower it or set him free earlier this week, citing the fact that his elderly wife couldn't tend to their livestock alone, but he was sent back to jail.

Cuen-Butimea tried multiple times to enter the US illegally before Kelly shot him dead.

Records indicate he was deported several times, most recently in 2016.

It's unclear if he ever crossed the border onto Kelly's property before the incident on Monday.

Sheriffs say they did not know each other.

Many of the details of the case remain unclear, including whether Kelly will be able to invoke a stand your ground defense.

As Kelly awaits his next court appearance, Cuen-Butimea's family in Mexico are mourning his death and demanding justice.

They held a memorial for him in their hometown of Nogales, just over the border, last night.

It remains unclear why the 48-year-old had crossed illegally onto Kelly's land, or if he'd done it before. He had been deported several times before, the most recent of which was in 2016

On social media, his relatives are calling for justice.

'We will get justice for you, daddy, I promise,' his adult daughter said alongside Kelly's mugshot.

The family has not explained why Cuen-Butimea had crossed over into Kelly's land.

In court yesterday, Kelly begged to have his $1milion bond lowered.

'She's there by herself... nobody to take care of her, the livestock or the ranch.

'And I'm not going anywhere. I can't come up with a million dollars.

'Would you consider reducing it to any degree?' he said.

The judge, Justice of the Peace Emilio Velasquez, told him his lawyer would have to file a request to lower bond.

Kelly was appointed local public defender Brenna Larkin, who is yet to answer any media inquiry about the case.

Arizona's Stand Your Ground laws

Under Arizona law, 'a person is justified in threatening or using physical force against another when, and to the extent a reasonable person would believe that physical force is immediately necessary to protect himself against the other's use or attempted use of unlawful physical force.'
It could be used as a defense when homeowners attack — or potentially even kill — someone to stop certain crimes like murder, rape or armed robbery.
The Stand Your Ground laws are not permitted as a defense, however, when there was only a verbal provocation or the homeowner who is claiming self-defense provoked the attack.
By using the Stand Your Ground laws as a defense, prosecutors have to prove beyond a reasonable doubt that a defendant was not justified in using deadly force in self-defense.

I don't feel any pity for boomer rancher. This guy wanted to live out the life of shooting illegal immigrants on the border so badly that he wrote a self-insert novella about it. He was itching to instigate a conflict where he could legally shoot a man. I can't feel bad for the fifth timer illegal immigrant either but there's nothing heroic about what Kelly did. The situation he put himself in was entirely of his own creation and he probably told the police lots of things that will be used against him in a court of law.

He's obviously going to jail. Arizonia Stand your ground law is: "person is justified in threatening or using physical force against another when and to the extent a reasonable person would believe that physical force is immediately necessary to protect himself against the other's use or attempted use of unlawful physical force.” All this dude did was trespass onto land and got shot and killed. If the dude started running with him with a knife, then it'd probably be a different story. Boomer is beyond fucked in this situation.

Murder only applies to human beings, not Mexico's refuse.
Statements like these are a hell of a lot more objectively evil than any Drag Queen Story Hour.

Absolutely. I 100% believe we need to enforce our immigration laws and secure the border, including building more walls...but that doesn't mean you get to murder someone in cold blood. That's just evil.

I wouldn't be surprised if there are more skeletons in his closet. Probably abused the animals too.

I don't feel right K turning into rural driveways. What was THAT dude thinking?
¡rápidamente! ¡rápidamente! mi pene donde las mujeres blancas en hey yo tienes un cigarrillo o cualquier trabajo de paisajismo va gringo? También donde puedo conseguir un pitbull?

Texas also has purple paint laws (a vocal telling that trespassers are not welcome and are risking their personal safety if they cross into the protected area).

Now, Arizona apparently is a state with Purple Paint Laws as well so if the rancher might be saved if he took precautions into this. If not then he fucked up because the entire purpose of the law is to basically convey NO TRESPASSING IF YOU LIKE LIVING. Beaner judge probably wants to throw the book at him and give the family a bunch of money so they too can come over to be dregs of society.
In the real world trespassing does not give you the right to outright shoot people simply for the act of trespassing on your land, provided you aren't stealing or trying to harm somebody. By that logic you could shoot hikers and hunters who get lost and wander onto your land. Go ahead and do that and see how fast you end up in prison. Use of force by law must be reasonable and proportional. You tell them to fuck off and you call the cops. You don't resort to killing the person without a reasonable justification. If all he did was cross the border on to your land, shooting him cannot legally be justified and you're looking at as blatant of a first degree murder as it gets

and if what @Un Platano said about him writing that novella is accurate this guy is absolutely fucked. The prosecutor will have a field day with it cause it makes it pretty obvious the guy was looking for a reason to shoot someone

That aside, this is an example as to why shooting blanks as a way of deterrence should be a thing. Or better border security. That too.
If you're shooting blanks you're admitting you didn't have a reasonable justification for shooting at them in the first place and that there was no threat to your safety. Same concept as a warning shot and the end result will be pretty much the same, as such things are big legal no nos. Not to mention the fact that if you shoot at somebody you had better be ready to kill them and had better be ready for them to defend themselves from being shot at no matter the reason. That could go real bad for you real fast if that person happens to be armed with something other than blank rounds

That's why I advocate for the US Govt placing a mine field along the US/Mexico border. Much more efficient than a wall, less labor intensive, and videos of people being ripped apart by explosives would probably dissuade the majority of criminals trying to border hop. It's not murdering someone in cold blood if they ignore all of the warning signs and razor wire and continue onward.

Fuck that.

Taco Smuggler doesn't give a fuck about American laws. He's been deported four fucking times. He had four chances.

Crazy author guy should be allowed to shoot the taco smuggler if he's too fucking dumb to realize no means no.

And LOL at spics in Spicland demanding 'justice' for their retarded border hopping drug smuggling faggot. I hope the cartels napalm their fucking house.

We need to go back to just burying border jumpers in an unmarked grave by the side of the road.

Ah, but consider the following.

Wall with manually operated machine gun batteries. Potentially hundreds of pest control jobs.

Good idea. nobody has ever regretted seeding mine fields, they are easy to control, and never main/kill anyone other than the intended target.

Deploying the military and putting them on permanent border control duty could work. This also has the bonus of if you wait long enough people will get used to it and won't question build up as much for a potential invasion of Mexico.

Our borders are where the bulk of our military should be deployed, defending American soil.

Not durkadurk oil fields or ungrateful Eurotrash or hohol money launderers.

This guy is gonna be the next George Floyd/Ahmaud Arbery, isn't he?

Ahh, that book goes a long way to explaining the million dollar bail. Dudes fucked, even a relatively incompetent prosecution will have a field day with that. He had better hope he has video evidence of the beaner actively threatening or attacking him, otherwise I don't see any way he gets out of this.

Most posters here saying that are either obvious shitposters or just trying to bait you.
I sure hope so...that's really mentally sick if serious.
100% unironically: it should be legal to shoot illegals on sight. Fuck it, there should be bounties given out for each head you bring in. That's what you do when you get an invasive species that is so destructive it's actively destroying your quality of life.
