I didn't say that, and even if it's true -- I would still say it violates the first amendment, and Nick's mentioned a while back that there's a group that's been trying to challenge the lawyers' professional rules on precisely these grounds and force them to change, with varying levels of success around the country -- it doesn't apply here. Nick wasn't directly communicating with the opposing attorney, he was talking on Locals.

I don't know why you bothered saying "It's not in court and it's not in a filing" then, since it's not relevant to your point. I was just giving an example of a type of conduct that could result in discipline. There's multiple ways that Rekieta may have talked himself into trouble, especially if the specific insults @Himedall All-seeing Waifu transcribed are accurate.

It's part of an argument that Montagraph should be considered libel proof for the purposes of the statements Nick made - the Kiwi thread is one of about a dozen exhibits Randazza introduced to argue that Montagraph is so well known for being a creepy weirdo (including alleged grooming and being a "Child torture film producer") that Nick's allegations of pedophilia could not possibly have caused further damage.

Proving libel proof is way too high of a standard to bother in here, imo, or was last I checked. Really hard to prove that someone is libel proof, and even in cases where the mainstream media spent over a decade hoaxing, lying, and ruing reputation, such people have not been found libel proof (see NY Supreme Court (equal to normal district court) Project Veritas case)

Nick Rekieta has disclosed near the start of his stream tonight that Monty's attorney, David Weldon Schneider, has filed an ethics complaint against him (Nick, that is).

Without even looking at it, filing ethics complaints against opposing counsel (or in this case the defendant) is generally regarded as completely retard, and this lawyer is probably a lolyer.

I don't know enough about choice of law analysis to comment on whether the attempt to apply the Colorado anti-SLAPP statute to this Minnesota case will be successful. But I think I like that tactic of putting all of Monty's shit on the record before the court right at the beginning of the case.
