He is a vexatious schizoid. But the attorney representing him isn't. With the massive amounts of cash income Nick is generating, he is a very sue-able position from a legal point of view. Nick is a better legal target than most of Monty's previous targets. Nick also mouthed off to the judge in the case in another case.I doubt you'll even get that. I mean, I haven't been following this case, but isn't the guy suing Nick some vexatious schizoid? Those lawsuits always bomb, even if it takes some time. It doesn't matter if Nick is talking shit on twitter, the tard suing him, no doubt, has no case and nothing Nick can tweet will change that.
Nick should have been able to easily get the case dismissed. But at every point where Nick could have done the sane thing in the case, he has decided to go in the direction of self-harm. His decisions to talk at length about the complaint and the case on streams was a tremendous mistake.
If the case goes all the way to a jury trial (and its feeling more & more like it might), the result is unpredictable. Its a conservative area and both Nick & Monty are going to look like faggot weirdos to the typical juror. Sometimes when presented with two awful people the jury can decide to punish the richer of them just cause. Or they could just wash their hands of it and give neither side anything.
It also of course depends on the legal defense that Nick's attorney presents. But Nick's long video streams have to a degree restricted the defenses Nick's attorney can offer in court. Truth might be a good defense, but Nick seems to be leaning toward a constitutional rights defense which is more complicated and more unpredictable.
It also depends on Nick. If Nick follows through on his intentions to stream about the case at every step, he runs real risks of (for example) getting the judge really angry at him. At one point, I would have doubted Nick would have ever done that. But at this point, Nick going on a drunken rant against the Judge doesn't seem impossible.
Its not the ordinary sort of case where the person defamed has to go to great lengths to legally determine the other side's intent and mindset in making the allegedly defaming comments. Nick has told them at length all of those things. Nick has already made the case several times easier for the other side than it should have been.
Nick shouldn't have ever been a situation where losing this case was possible. But with every stupid act of his, he is increasing the (still slim) probability that he might lose.
