That was a Minnesota case bro. Surprised me too, I was under the impression the 1st Amendment made suing for this sort of thing pointless but apparently not in Minnesota.
That said in the case cited "Pat the Pedo" could prove actual damages (the loss of his job as a cop) whereas Monty is going to have a hard time proving damages from this, especially since Balldo Man isn't the first person to call Monty the Pedo a Pedophile, Monty's reputation is already dogshit and has been for years, I remember Jim shitting on him years ago, I'd like to see him try to prove his reputation is worse after Balldo started shitting on him than it was before.

It is something I’ve heard many a troon say, pre-troonery. First they envy women, then they want to be one. With Nick’s recent aversion to anything that isn’t living life on easy mode, a Nick troon out would be surprising, but not entirely shocking.

I could at least see some drag show participation or similar. All in good “fun” though, to be sure!

I read through that case when Quest v. Rackets started. IIRC, there were at least two appeals and the whole thing was a mess.

In the end, Pat the Pedo couldn't prove he lost his job because of defendant's actions.

My recollection is that after years of litigation, he got $750.00.

ETA: The case is so old that the docs aren't available online. The docket report shows the amount of the final judgment, though.

Sure, the size of the damages wasn't the bit that I thought was interesting. At the time, people here seemed to be suggesting that it was open and shut -- Rackets would have it thrown out on first amendment grounds, as soon as the judge laid eyes on it. (Hence my reference to the UK here. That just seemed so contrary to how things happen here, it just seemed to me that the law in the US would have to be more nuanced than that. And of course, it is.)

The things I thought were interesting about it and were in direct contradiction to what Rekieta was claiming about the case were really the following things:

a.) A Minnesota appeals court had found that calling somebody a paedophile was defamatory per se. You didn't need to prove that your reputation had been damaged to get a finding against the person who defamed you, as long as you hadn't actually diddled any kids, you'd win your case.

b.) It didn't matter that everyone else in the area also called him Pat the Pedo. He wasn't suing everybody else. If somebody had publicly called you a pedo, they'd defamed you.

So even if you had a reputation as bad as Monty's, while you might not be able to make a fortune in damages, you'd definitely be able to drain his bank account by taking the case to trial, and you'd be able to drag him through the deposition process, humiliating him as you asked him about various aspects of his on-line pontificating.

If we could find this stuff with the most basic Google search, surely Rekieta, with his access to LexisNexis and the other great tools for looking up case law, surely he'd found it as well. Why wasn't he addressing it? How come he wasn't telling us that it didn't apply because X, Y and Z?

Perhaps it was because he didn't want to give away his cunning legal strategy to his opponents? But that didn't sound like Rekieta to me. Anyway, I just wanted to hear what any of the people who had some experience of the US legal system had to say about the case and it's applicability to Montagraph vs Rekieta.
 
I just remembered that when T. Greg Douchette (perpetually bankrupt lawyer from Weeb Wars) was using Randazza to sue some Confederate group, Nick made jokes about Randazza going "where's the money Greg?" like it was a mafia shakedown.

Since Nick is buying himself all sorts of unnecessary expenses like a flashy Mustang and a week in Vegas with a venue for his Noseguards and the lawsuit looks to be running up a lot of expenses, finances in Balldonia might not be doing too hot soon. Question might quickly become "where's the money, Nick?"
