What did Vic Mignogna in wasn't Sam Johnson. What did in Vic Mignogna was someone's insane recommendation that he should hire an estate and trust attorney in a defamation case.
While sure, Sam Johnson wouldn't have had anything to do if Ty Beard hadn't fucked up, but it was Sam Johnson who found the Tylophone Notaries and brought them to the defense's attention. If he hadn't noticed them, the case would've skated (at least partially) past TCPA, and when the defendants objected it would've been moot at that point. Johnson also let Lemoine do all the work, so he wouldn't have to charge his client more billable hours.

What did Vic in in regards to Ty wasn't because Ty got rings run around him by the TcPa ExPeRt Lemwaaah, he literally didn't get critical papers filed in time. You'd think an estate and trust attorney who regularly deals with more money than Vic was suing for would at least get simple paperwork done right.

That's what made the whole Mignogna saga so disappointing. It wasn't that the facts were against Vic, or that opposing counsel were more masterful in their motion practice, it was that Vic's lawyer tripped on his own shoelaces at the one yard line.

His most famous criminal plea deal was in that case where the wife of a gay minister embezzled hundreds of thousands of dollars to spend trying to romance the gay out of her husband. Her thefts ruined several businesses. There was a plea such that she would serve no prison time at all. The judge rejected the plea and sent her to prison. Nick's legal genius in criminal cases didn't really work out well for Melanie Daniel.
I can't really fault Nick for at least trying for no prison. It's his job represent them zealously, even if the client is probably a piece of shit.

It's also only Nick's account of what happened, but the judge seemed offended that the defendant was so privileged to have private counsel, even though Nick did it pro bono.

Update to this: unless I'm missing something, Randazza sent the letter to Schneider on February 22, and that should mean that the safe harbor period has concluded. We can now wait and see whether they follow through on filing a motion for sanctions against Schneider/Monty.

Nothing new is showing on MCRO at this time.
What if the givesendgo is for the cost of Randazza filing for sanctions. He told Nick he'd file it but it'll be 50k extra cause he would rather actually be working on the case instead of the slap fight.

Promising anything else than that would be fucking negligent.

Why did Vic not sue Ty? Here in the UK, if a lawyer is obviously negligent you've got a clear cause of action against them. One of the biggest costs of being a lawyer is the cost of indemnity insurance because of how much they have to stump up for incompetent representation every year. Failure to file papers on time would be a cut and dried victory over here.

The appeals court all but explicitly called it malpractice. He would have had a solid cause of action. Vic is just a too-nice guy, because he probably would have got a settlement out of Ty's malpractice insurance, assuming he has it (it is not actually required in Texas but anyone who handles money as big as Ty does probably does).

We also don't know whether they came to some kind of agreement on it and probably never will.

That or he is afraid that Nick's fans would destroy him PR wise permanently (and loose the goodwill). Latter not really likely nowadays.

I'm not convinced Ty is really a "big money" attorney. Are the Rekietas actually in the 8 figures (with a leading digit >1)? Trusts for a few million don't have a much on the line.

No idea about the total of the estate, but Nick's maternal grandparents donated $18 million to a hospital in Tyler. There's a wing named after them that you can look up as well as news articles from the time. So I'm going to go with "yes".
 
I know about the legal definition of vexatious litigants, but is there a legal term Judges and lawyers use for bumbling amateurs like Spergtre constantly trying to insinuate themselves into legal arguments other than "Irritating buffoon" or "Meddling faggot"?
 
I always had lawsplaining as my background noise at work and ever since he started focusing on Rumble that hasn't been as much of an option because I would always use youtube's download feature to listen and that happened around the same time so I haven't been able to keep up as easily. Rumble is a massive bandwidth hog even compared to streaming the youtube videos so streaming them from Rumble doesn't really work for me, not to mention I can't pause the playback with my headphones.
I don't know if this would work for you, but here is how I deal with the hurdles added by using Rumble. First, I have my phone always running on a VPN. Second, I connect to the wifi at work. Third, I listen at 2x speed (I'd prefer 1.75, but the Rumble app doesn't have that option). One time I wasn't connected to the VPN and Rumble wouldn't load. When I connected to the VPN, Rumble loaded. I tried not connecting to the wifi at work, using my data plan and burned through my data for the month in 2.5 weeks.
 
Unfortunately I don't have an office/retail job where I have consistent access to wifi, that's why the downloads were so valuable to me. I have had it this week so I've caught up on a few of the recent streams

I might try and figure out how to download the videos from Rumble and just watch them via VLC but I've mostly just been listening to other stuff. Lawsplaining was a nice consistent 3-4 hours which, with pauses, tended to get me through most of my day

FWIW, I hope Rekieta prevails over Monty, but I also think anybody that contributes to the GFM should be legally obligated to wear a retard helmet.

Personally, I think that's a reasonable and fair position given what I know about both parties.

ALSO, late and gay, but...

Spectre promises he has more games than Milton Bradley if Montagraph wants to play games. Says he will SLAPP the shit out him and thinks Randazza will represent him on contingency. He's this close to submitting an affidavit and doxing himself on behalf of Rekieta.
It sounds like he's gone full on @JosephTX.

Wouldn't all Schneider have to do is ask him questions about his rank in the Marines, his alleged FBI and Pentagon contacts, and whether he was a lifesaving hero at the Boston Marathon bombing?

I mean, "goes to credibility," right?

I'm not saying it wouldn't be funny putting Spectre under oath and legally forcing him not to lie (for once), but I think having Spectre deposed (or involved in this case in any way) would be just about the last thing Nick would want. I can't see anything good ever coming from it, and Randazza would be a fool for allowing it.
