Nick may be technically right if the standard is 'intent', but how do you know what someone's intent is? People go with what their interpretation of the evidence of his state of mind was. They largely make up their mind based on their own experience anyway, you are not changing it nor convincing them that *you* understand it as something else.

Perhaps it's just me, but if I was in Rekieta's position, having blown $75k on the first phase of a lawsuit that has the potential to ruin him if it goes wrong, I'd definitely be going out there and getting a few other opinions on whether I'm dealing with this in the most sensible way that I could.

Not that I think Randazza is fucking him over, but if you're a lawyer and another lawyer approaches you, telling you that they're being sued for defamation and they want you, as a first amendment specialist, to do your thing and mount a defence on your behalf, then why wouldn't you take them at their word and act according to their instructions?

But if it was me in that position, I don't think I'd be quite so certain of where I stood. Particularly given how high the stakes are. So I'd be finding myself a couple of local defamation specialists and booking myself a few hours with them to find out what they thought my chances of winning were. I'd want some sense of the range of opinion out there. And how that range skews. So some lawyers might think it's a winnable case: but what proportion? 75%? 50% 25%? 5%?

But then I wouldn't have said it in the first place. And if I had, I'd have immediately apologised because I knew what I said wasn't true. But if I put that to one side, and assume I'm a drunken loudmouth who accuses people of committing the worst possible sexual crimes imaginable without any evidence that they'd done that, how do you risk such a big chunk of your family's money without being absolutely certain that you're fighting a winning case? Knowing that you'll never recoup any of it even if you win.

Back in Nov/Dec, before the kerfuffle with Monty's lawyer filing for summary judgment because Rekieta allegedly missed a filing deadline because he claims he hadn't formally hired/paid Randazza yet, Nick lied and boasted that he had already hired Randazza on stream.

He said he would only have Randazza represent him under the condition that he could say whatever he wanted about the case on his show and be as belligerent as he liked.

And he claims that Randazza responded that "He wouldn't have it any other way."
