Tony fucks it up because obscenity isn't the only route by which sexual content may be restricted. True, the first amendment says that the main way sexual content can be totally banned by statute is through obscenity, but material that is just indecent can legally be restricted to adults only.

Does he think strip clubs and burlesque shows can't be legally restricted to adults only?

Tony doesn't know that time, place and manner restrictions all comport with the First Amendment, nor does he know that zoning, business regulations and commercial speech have all been carved out as exceptions. I really doubt anyone uses the "obscenity" standard to defend zoning adult businesses and restricting certain things to them when there's everything else available that the Supreme Court hasn't indicated they won't consider eliminating if they have to. (As I always like to emphasize, and especially for our non-Americans, a conservative Supreme Court voted 8-1 that crush videos are not obscenity and thus are First Amendment protected. The current Supreme Court after the Trump additions continues to have at least 7 votes in this direction, even Thomas does not typically go against the grain on most First Amendment issues not involving schools, only Alito does. More of the "progressive" justices have voted for First Amendment limitations in the last 20 years.)

I should probably actually look at that Tennessee case to see if the state even argued based on obscenity, it's not like Tony probably read it. Tony thinks they "won" the case even as he quoted the part where the judge just said it could proceed to trial rather than be immediately dismissed.

From my position across the pond, it does seem that, for a substantial group of people on both sides of the transgenderism debate, this has become an issue where they need to rally to their preferred faction because the other side is basically the devil.

This is just how we treat everything in our national sporting event and past time: partisan electoral politics.

Blair White had Dr. Deborah Soh on her channel where Dr. Soh illustrated that the transgender identity has characteristics that are highly diagnostic of certain mental disorders. I found Dr. Soh quite engaging and worth ones time and made a nice thumbnail.
