Didn't Labelle whine about how people 'literally' get away with murder all the time for using the bullshit "didn't know I slept with a tranny" defense? She made a comic about this twice so I guess it's just a weird fantasy she has to get back at all those cislords who don't want to sleep with her.

Tiny bit of law spergery: that defense is the epitome of "just because you can doesn't mean you should". Trans panic as a defense has, too my knowledge, a less than 1% success rate. Also note: it's a DEFENSE, not a law. The difference being that defenses are used to try and get you off the hook, but can backfire and make a jury want to throw your ass in jail even harder.

I think the problem is LaBelle assigns to the punching up/down mindset (Which suits him well since it's based on arbitrary privilege points rather than considering individual circumstances) but the problem is while it's more or less harmless when it comes to something like comedians since if you don't agree with that ideology you can just not attend or watch them but when it comes to relationships it implies certain groups should never turn down or refuse to date others deemed as part of a less privileged group or they're bigots who need to be shamed until they agree to date.

It's a terrible strategy in most cases. I don't think it could be constitutionally prohibited, though. The one place I could see it succeeding is in a first degree murder case where the prosecution is arguing a premeditated murder or hate crime of some sort, and the defense is arguing that the killing was a spontaneous angry reaction committed without premeditation. In that case, the killing is simply not a first degree murder, as premeditation is an element of first degree murder.

About the only thing that would do is take death off the table, since second degree murder usually also has a max of life. So the issue would only be critical in states with a death penalty that's actually used.

California specifically outlawed it as a provocation defense. Provocation is also generally a mitigation defense, i.e. defendant admits guilt but X, and it only lessens the severity of the offense. I was indirectly referring to this when I suggested outright prohibiting it as a defense would be unconstitutional, because there are cases where the motivation of the defendant by a sudden rage would prove the defendant had not premeditated the crime, if the prosecution were arguing that. A defendant must always be permitted to negate elements of the offense, even if society finds the method of it distasteful.

I don't think transwomen should have to disclose their trans status up front, but at least mentioning it before I shag them is the honest and right thing to do. You can't have a relationship built on lies.

All this actually made me thing that 20 years ago, on the British soap Coronation Street, this actually happened with Roy Cropper finding out that his then girl friend Hayley had a pickle. But he didn't chimp out and murder her in a fit of rage. He didn't take it well but when she had reassignment surgery they got back together again and the whole trans thing never got between them because it was all out in the open.

I think this is probably a more TRUE AND HONEST depiction of such things than the ridiculous idea that finding that your girlfriend has a cock makes all cis men go MURDER DEATH KILL MURDER DEATH KILL MURDER DEATH KILL. But the Tumblrinas probably would find it problematic because Hayley was played by a cis actress and it's therefore CISSPLAINING.

Wasn't she outed by Mike Baldwin though? If I remember she was working for him at Underworld and he was partly to blame for outing her.
