Jim Sterling / James "Stephanie" Sterling / James Stanton/Sexton & in memoriam TotalBiscuit (John Bain) - One Gaming Lolcow Thread

Do it pussy, bring a suit with all your "evidence" and try to claim YouTube has a duty to maintain your performance. Aren't you the big bad Jim Fucking Sterling who causes corporations to quake in their boots? Yet you're hiding all this evidence and working back channels begging for free promotion as if you should matter and deserve special treatment? Expose them, conquer them, crush them, enjoy the lamentations of their women.

I know why you don't, but I'm sure your fans would enjoy an explanation of why you don't.
Imagine being a fan of Jim Sterling these days?

The thing I do not get if he makes no money from Youtube and all of it comes from patron what damages can he claim? I am not a law expert but if there were damages out of his control than yeah , but he just pan to a different part of the picture or censor the junk.
As others have pointed out he has no legal leg to stand on (Google, for all their faults, are not dumb and have T&Cs for a reason) but if I had to guess his retard logic is YouTube are in essence boarding up the shop window he uses to advertise his wares to get people to where he makes his money.

The problem with this is he did not lease a channel from YouTube, he did not enter into any formal business agreement with them. In reality, it's closer to a bum trying to sue the cops for moving him off the corner where he was selling pirate DVDs.

This might explain why Jim isn't rich though, if this is the sort of frivolous nonsense he wastes legal fees on.
Although I do agree with him that tranny status plays a part in this, just from my personal experiences and observations, people don't like and don't engage with tranny material; only other trannies or "allies" do so.
This is only true about a very specific type of troon material (into which Jim falls), which is the troons who cannot discuss any topic without shoehorning their transness into it. Creators like Contrapoints do extremely well on YouTube because, even though he does often make videos about alphabet people issues, he focuses first and foremost on making his videos entertaining and has great production values (this much is obvious when you compare how he looks irl to his vids).

The kind of 'trans content' Jim puts out is the worst. Even without the gender nonsense his vids would be repetitive, but now no matter what he's talking about he always has to make it about his transition. As I've said before, it wouldn't matter if he was preaching the Bible, extolling the virtues of anime or trying to sell you a timeshare in Barbados: people hate people who can't shut the fuck up about their pet issue, (even if they share the same beliefs,) especially when it has no bearing on the current topic.

Jim's position against YT is two-fold.
  1. Auto-moderation and the following back and forth while Youtube has unfairly robbed him of visibility during the important initial upload window
  2. Youtube has historically been biased against him

Now the point about losing visibility and being denied views would be true if the video had noticeably lower view count and while it sits at the lower end of total views currently its still within the view range he gets so this isn't a strong argument. I don't know enough about Jim's history with content restrictions and I don't particularly care enough to try find out but I doubt its anywhere near the level he's making it out to be, you'd think he was having to fight to get monetisation on every video or something with how he is describing it.

Its especially funny since he frames the mistakes as "mistakes", yes Jim someone at YT has a vendetta against you and you're not facing the reality of being a declining channel with low-level views compared to his sub count. You're not valuable so you don't get special treatment anymore.

Lol, he said The Word.

The tone of his Tweets and invoking the holy LGBTQWTF hints at a discrimination claim - unless he really thinks that he’s the first person in over a decade of YouTube’s existence to suffer a moderation fuckup.

Jim’s channel and website have been plagued by content restrictions and angry gamers for years and apart from his ‘copyright deadlock’ workaround it never got more than an irate side mention, but now that he’s stunning and brave gendertrash, well, clearly the retribution via moderation abuse from a group of people he intentionally antagonised exacerbated by the unfortunate occurrence of this incredibly frequent and indiscriminate digital context recognition error from an unwieldy algorithm that was not rectified promptly (on behalf of a man who is on visual record with cum on his face, waving a meter long dildo and interacting with collectible milk caps in an unambiguously sexual manner) due to the well known prevalence of inconsistent standards and priorities among a handful of overwhelmed video auditors for a platform that publicly endorses all iterations of his claimed protected demographics that uploads thousands of hours of content quite literally every hour probably means the Nazis have won.

Jesus Christ, don't give us posts in the style of the Jimquisition, please!

(That was pretty well done though, by the end I could hear Jim's nasal whine while reading it).

With respect to discrimination, how difficult would it be for him to prove this under US law? In many other jurisdictions he would be pretty well fucked because YouTube have two counterarguments:

1. YT does not discriminate against trannies or Sterling, and then show a variety of other tranny channels as evidence, as well as the fact that Sterling is not restricted from exercising the usual functions of a youtube channel.

2. YT could alternatively say that Sterling's channel  is under more restrictive monitoring than is usual, but not because he's a tranny, because he is Jim Sterling, then show that his channel is aimed at all ages but he is known to use a lot of foul language and show lewd imagery, thus his channel needs the extra attention "for the sake of the youth".

In general, the second argument would be used if Sterling has some evidence that his channel is under stricter restrictions than average.

Is there something in US discrimination law that would render the above arguments insufficient?

Another thing: This stuff is usually litigated in higher courts, mainly because it can set precedents. That would be one of the circuits of the US Supreme Court, afaik. (Heaven knows which one, seeing as this is a foreigner trying to litigate from overseas)

As I mentioned before, this needs serious money and I don't think Sterling's paypig sty will be very willing to cough it up.

Keep making impotent threats, Jim (or amuse us by trying this shit on.)

So... What will jim do if he gets banned from youtube?
idk but it seems like that's what he's aiming at, intentionally or not

Maybe he's used to being entitled to all sorts of benefits but youtube isn't one of them. And threatening to involve lawyers while you "build evidence" is a really, really good way to have a corporation terminate any interaction with you other than through legal counsel.

This is the first vid of his I've watched in a dog's age, and good GOD, his privilege is on full display. I especially love the bit where this self proclaimed "enby of the people" rips an innocent social media manager's balls off over something they have zero control over. They were using a script and sounded like a robot? No shit, Sherlock: *that's what you have to do when you work in customer support*.

Not that that this ham planet had ever worked a day in his life...
