Keeping any animal that isn't a cat or dog is closer to animal abuse than anything else. Dogs & cats are exempt because they have been domesticated for thousands of years. Under its original interpretation the First Amendment applied only to the federal government, not states, and to the extent that states protected speech it was political speech. People were still being jailed for blasphemy as late as, like, the 1850s? Maybe later. The states gave direct funding to state churches too.
