Someone correct me if I'm wrong, but Isn't "Timcast" a news site with sometimes opinion pieces? if so then people can use their "news" for videos like any news site right? if I'm correct then Tim Pool would have to admit his site isn't a news site.

The only way I could see how he could win such a case is if it some how hurt his reputation. Similar to the CBC case against the Conservative Party in Canada (CBC actually covered their dismissal in a news article back in 2021 since you know fuck being unbiased. There's also a good reason why they support Bill C-11 and censorship). However that case was dismissed for a few reasons and in Pools case, he has no reputation to damage.
Copyright laws still effect political parties. That also means thing Fair use also apply to them as well. 8 second clip of Pools along with others plus some statements would be fair use.

Pool has no case that's why he is not threatening a lawsuit, the Desantis team used a few seconds of a larger clip from a "news site" with enough changes to be considered transformative. the only minuscule posibility Pool has to win anything is if he admits his sham of a site isn't a news site but a personal blog (ran by other people) and he copyrighted the video (like how photographers do with the pictures they take)
TL;DR: Pool is a retarded grifter and wants attention, he wants to desperately put himself into election news.
