Applying Colorado law here would contravene Minnesota's interests in fairness and equity. It isn't that Minnesota has never enacted anti-SLAPP legislation; It did. However, Minnesota decided that the statute was unconstitutional. This isn't a case where another state's law can fill a void that was never legislated. Minnesota courts have spoken clearly that anti-SLAPP legislation is unconstitutional, abrogating an individual's right to a trial, when it requires pretrial factual determinations. As such, Minnesota has made a determination regarding the state's interest: anti-SLAPP statutes are suspect.
