It's always been my understanding that the chance to make the "Colorado argument "was the reason why Randazza even took Rekieta's case. The idea was that Randazza was going to perform a legal coup by grafting Colorado's anti-SLAPP onto Minnesota's jurisprudence.

That is an excellent point. But it wouldn't be about grafting Colorado's anti-SLAPP law onto Minnesota. Its about using the rare circumstances of Nick's case to create a test case that allows for re-litigation of the issue of anti-SLAPP being constitutional in Minnesota.

If the state courts allowed the Colorado law under the logic of Randazza's plea, they would create a template by which an anti-SLAPP law could be passed in Minnesota.
In normal circumstances, it would be nearly impossible to re-litigate the anti-SLAPP minnesota decision. You couldn't get the courts to accept it. But Nick's case would allow it to happen because of one of the parties being from a different state.

If this is indeed true, I would expect an appeal from Nick. Randazza will appeal this all the way to the State Supreme Court even if it doesn't serve any of Nick's interests or that of his case.

And the best part for Randazza is that Nick is paying all the bills for Randazza's law nerding.

I think this comes in somewhere in the territory of Elon Musk's "pedo guy" lawsuit, i.e. not a terribly strong case but probably presents a colorable claim.

I definitely agree this is where a sane person contemplates settling.

I also definitely agree that an interlocutory appeal is a fool's errand but Nick could insist on it.

However, I think that would be a hilarious motion to make here given the subject matter of the case.

"Defendant respectfully motions for the assignment of a new Judge, on the basis that he shit-talked the currently presiding Judge in relation to a prior case, and the instant case concerns allegations that the Defendant has shit-talked somebody. Therefore, the Defendant has good cause to believe the presiding Judge may be bias against his shit-talking ways."

Basically, I am at a loss as to how you write such a motion without admitting to the court you are an asshole with a propensity towards shit-talking. Any replacement judge is gonna have access to the motion as well.

Moreover, I would think that the Chief Judge (if it ever got that high, see link above) would presume that Judge Fischer is professional enough to rise above whatever Nick said in the elevator. Judicial officers tend to get the presumption of impartiality absent compelling evidence to the contrary.

Certainly some of those revelations are more understandable and sympathetic than others, but at a certain point your character is forged in the hard times not the easy ones. Recently it's become more obvious that Nick thinks he's better than everybody, and is always the smartest guy in the room.

For me the turning point was when Ty Beard fumbled Vic's case after talking shit for months and taking huge sums of money. I was shocked when I found out that Ty Beard was Nick's family probate attorney. Wtf.

The comical level of failures in Vic's defamation case really exposed the laziness, nepotism, and incompetence in hindsight.

You don't get to act like an asshole and then claim this is evidence of the judge being biased. Smarter people have tried the "shit-talk the judge then call them mad and try to recuse them" trick than Nick. It requires the judge actually to do something to indicate bias, and no, just ruling against you doesn't count.

You're also a lot less likely to be granted such a motion if you wait until they deny your motion to dismiss and the case is headed toward trial. It implies you only decided the judge was biased after they decided against you.
 
Nick addressed the issue of "per se" defamation by saying that other jurisdictions don't apply it in the case of pedo. Nick also says the minnesota case law doesn't count because its old.
The Pat the Pedo case had it's last run up to the Minnesota Court of Appeals in 2007. Longbehn v. Schoenrock, 727 N.W.2d 153 (Minn. Ct. App. 2007). That, in the legal world, isn't old by any stretch of the imagination. Also, it's still precedential and the District Court can't, or shouldn't at least, just disregard it since there is nothing, at least to my knowledge, to indicate that these types of claims are being looked at as not defamation per se by the Court of Appeals or the MN SC

Nick just hand waving away caselaw on point because it goes against your current position is not just lazy, but actively stupid. Either distinguish it from the current case, give examples of higher courts seeming to move away from that case's position, or say why that case's argument was wrong. You can't just be like "It's 16 years old. Therefore it doesn't count."

I assume you have to show cause later, including why you didn't strike right out of the gate. I generally approve of such strikes early on, as it doesn't force a litigant to have to basically call the judge a crook to disqualify them. It's called "appearance of impropriety" but the definition certainly seems to require actual misconduct even if not actual corruption.
