I'd like to remind everyone that Virginia is old as shit, incest not being a sex crime probably made sense at the time, because the classification didn't exist.
Yeah. Well also, the lack of categorization makes a bit of sense in that the main purpose behind something being a "sex crime" is that you can have "sex crime registries", and that's mostly so you can know about dangerous individuals in your area.

Two degenerates engaged in consensual incest, which legally this was, aren't a risk to the general community.

We know there was a decent chance Barb was out of her mind and that this was properly a rape, but she wouldn't testify and the state couldn't prove anything beyond incest. So this unfortunately makes sense.

No. He was in 23 hour/day solitary confinement and his contact with other inmates during that 1 hour of out time was extremely limited. Rapes, especially in county jails, are very rare due to PREA.

True enough. That's another thing, the state couldn't prove shit. Barb wouldn't testify, and the only evidence they had was the ramblings of a autistic man, or in a legal sense, toilet paper. Even if it's likely he raped her, it can't be proven.
