If you read through the lawsuit its laying out those factors for the confusion based trademark liability.

Some of the arguments are pretty weak - intent, similarity of the mark, etc. I didn't bother looking at the other causes of action.

Here's the hilarious part - these two idiots might be deposed in the ISOM lawsuit since it may have been one or both of them who sent the email. The email is in the complaint filing, as evidence of the 4th factor. I have to add the caveat that its only if the lawsuit makes it to the discovery phase (and of course if they sent the email). I imagine lots of people who have contended that Dick is slowly morphing into Maddox (Maddax is one of the funniest nicknames for Dick I've heard on here) are feeling pretty vindicated. Pretending to be a journalist to try and fuck with people you don't like was a tactic infamously used by Maddox, so if Dick/Vito is involved and it leads to a lolsuit, it really does feel like Maddaxification has been completed.

As for whether he actually did or didn't do it, I'm torn and lots of things don't add up.

Eric's case is pretty succinct and makes a clear, logical case. "It was a fan bro, I swear it wasn't me" sounds like lying cope to anyone with a brainstem. Now, some people have pointed out that "Roy" (the fake journo persona) links themselves directly to both podcasts that Dick and Vito are on and that it would be really stupid to try and instigate litigation against a business competitor (Vito also is making a comic) whilst implicating yourself. To those people, I ask, are you people unfamiliar with Vito's history? Yes, he really is that fucking retarded. What's giving me doubts is, they have to know Eric is serious enough to pursue this issue legally and given their statements identifying them with the email address, they've got to know something concrete is needed to pull their asses out of the fire.

I do think there's another possibility that people aren't considering. What if this "Roy" persona really is another person, and is someone acting with more direction from Dick/Vito then they are letting on. I say this because it's the only way I can reconcile both the "we sent this email" and "it was a fan" statements. Dick responds to a lot more messages than you'd expect (hell, he's even replied to me in the past) and audience interaction is a big part of The Dick Show. It wouldn't shock me if some Dickhead posted the Charity Emails in the IRC, or emailed them over and Dick thought it would be funny to put them on blast. Redacting info and not giving credit makes sense, it is sketchy behaviour. Taking credit actively and acting as if you wrote the email, why the fuck would you do that?

With that in mind, I think back to the the Ministry email, it signs off as "reporter for TDS news", which doesn't appear to be present for the last email. Why add that moniker now? I think it is possible, that another person wrote the first email, Dick became aware of it, spoke to the guy and decided to take credit for the email. Then, either Dick or Vito directed, or encouraged (explicitly or implicitly) this other person in further email writing shenanigans, which resulted in the Ministry email and "Roy" feeling emboldened enough to stamp it with TDS seal of approval. Now they're hoping to sell the guy up the river if it comes to trial. Not certain on any of this but it does make a lot of things click.

But, on the topic of E-celebs morphing into others, if Dick is now Maddox, I think what is uniquely frustrating about Vito's continued presence in The Dick Show is how much he resembles Mundane Matt.

Mundane Matt is a fat (ex) LA liberal whiny pushover desperately hungry for fame and attention who tried to garner it with a combination of snarky passive-aggression and milquetoast, bland commentary. Despite his permanent blandness, he somehow was constantly involved with controversy, for defending individuals over unusual statements pertaining to children and consequently being accused of paedophilia enabling or apologia, he also managed to get into a shitfit with the comicsgate community after openly disrespecting well-liked prominent members with little good reason. In addition, despite his public stance as being pro-free speech he has numerous incidents that put this into question, both flagging people who make fun of him and supporting the censorship of others (Roseanne Barr) because of their "offensive" content, this causes people critical of him to reflect on how he acts in the defence of one type of speech but not another. After the incident surrounding the flagging, he blamed his mental state and anger on his behaviour and meekly apologised, though he is still licking his wounds to this day. He also famously cried on video.

I know it's not exact and you have to emphasise some things and gloss over others to get them to match but, the similarities between Mundane Matt and Vito are striking. Oh and, both are only known because of a whore (ZQ for Matt, Belle Delphine for Vito). This just makes Dick's marriage to Vito so confusing, I can't be the only person who has noticed the parallels, and I can't believe that it hasn't been pointed out to Dick before either, especially when he defends Vito flagging people with "he was angry", almost exactly the "bad headspace" line trotted out by Matt Jarbo. It's got to be fucking embarrassing spending all that time decrying a guy only to have his creepy, somehow fatter, twin sitting across from you as a co-host.

Also, as an aside, Vito is a lesson to me, to trust my gut. I hated the guy from the moment I saw him, even with no reason why (aside from physical appearance) and it's weird to see my intuition on the guy pan out year after year.

If you try to log into the account it has been deleted. There is no associated email address to restore it. If you Google search the phrase you’ll find various deleted tweets (the twitter account was suspended), including a now-deleted exchange between @AnObtuseGnome and Eric July. A Twitter account with the same handle has had exchanges with Dick. The only way you can tell these and others are associated with @AnObtuseGnome is by searching for the tag on Google, and unhiding the hidden results. I don’t know how long they will be available. Honestly, it seems like a generic right-wing troll account. I think the full list of tweets would be embarrassing to be associated with for Dick and especially Vito.

ACTUALLY........ according to Null himself everything from Dick's NP2 to his cuties obsession can be traced back to Null. look back at that whole saga, Null spefically says that if dick didn't associate with him then the site would still be up.
