So it's only an option if the judge thinks "the facts found by the court would justify a finding of guilt".

We don't know for sure but likely Chris's lawyer was trying various other tricks like having him declared legally insane or running out the clock on the original misdemeanor charge. When that didn't work he went with the autism exemption.

My personal feeling is they also spent that trying to figure out where to put him if he was released. It's hard to know what really went down because the whole process was suppressed, probably to avoid prejudicing the jury if it had gotten to that point. The only solid information we have are a few notes on when he appeared in court or moved between institutions.
