Successful people do not behave this way. I am fairly certain this guy has maxxed out a lot of credit cards or taken out some loans or borrowed money from family or something. Most people don’t just have $17,000 lying around for a rainy day in case they want to fight a subpoena. It’s not something that happens.

$17,000 is a ton of money for anybody other than independently wealthy people. You don’t just have that lying around usually. Not without dipping into your 401Ks or other retirement savings, if you’re lucky enough to have that. Which is why I think its very possible that he found a lawyer, and that lawyer told him “Hey, this is a nonsense lawsuit. This is a nuisance lawsuit. Whatever money spend we can take it from them”. I’m pretty sure he’s gone enormously into debt over this. Of course, I have no way of knowing that for certain, but I’m pretty sure he’s put most of this on credit cards, or taken out loans. Or borrowed money from someone in order to maintain this, with the promise to either himself mentally, or to family or friends or whatever that in a couple of months I’m going to get this all back.

Another thing, as long as I'm wildly speculating. If he somehow does get the appeals court to apply Colorado's SLAPP law to this case, the trial court hasn't addressed this yet, so the mandate on remand will likely not be to dismiss the case, but for the trial court to apply the Colorado law to this case.

I am fairly confident this would survive a SLAPP motion even in the unlikely event one is applicable, barring a Beard-level fuckup. Case in point, Musk's defamation case, which involved far less explicit accusations of pedophilia than Nick's. Whether anyone believed Nick's statements and thus Monty's reputation was damaged seems pretty clearly to be a fact question for the jury (or judge in a bench trial).

Dunford is also generally hostile to the tort of defamation. I'm mostly in agreement with that, in that I think the vast majority of Internet defamation suits are lolsuits that should go down in flames. I wouldn't even mind seeing this one do that, not because I wish Monty any ill at this point, but just any precedent that bullshit on the Internet should be taken seriously is likely to be misused.

That said, I believe it passes muster under current law for what is actionable defamation, much as did Vic's. Accusations of pedophilia presented as actual fact are defamatory, and if not, defamation basically doesn't exist in any real sense. While I don't think that would necessarily be a bad thing as a policy matter, it would really need to come along with some other social mechanism for deterring or reducing the harm from character assassination, like education NOT to take Internet bullshit seriously ever and that the default is such accusations are lies unless proven otherwise.

The problem is cancel culture has basically acted as a magnifying glass to intensify this shit to the point the Eye of Sauron can burn you like an ant if the mob decides it. If we don't have defamation law, we're going to need something else to replace it.

However, I don't think that's a good enough excuse for Nick to say what he said. I think a person should exercise enough self control to avoid falsely accusing somebody of being a child molester.. Nick came completely off the rails here. Worse than coming off the rails, actually. Falsely accusing somebody of being a pedo is coming off the rails. Falsely accusing them of being a child molester is coming off the rails, skidding into an orphanage, and then exploding. Monty didn't deserve that. I don't care how weird he is.

My post was long, but pretty narrow in scope. It was focused on Drexel and T's relationship and establishing that it's rooted in who Drexel is as a person (not just jokes) and how Nick fits into giving him a platform and generally being supportive of Drexel's degeneracy (again, not just jokes).

A proper OP would require his basic details (his age, lives in his mamas house), brief personal history (smash bros. etc), beginnings online as Rekieta's shield and establishing Migtown, an overview of his degenerate interests (gangbang liaison, 2.5-somes with a midget, transsexual encounters and impotence, grooming allegations, etc.), culminating in him gaining more exposure than he bargained for courtesy of KF.

Most of the information is in this thread and would just need to be organized as a launching point for other farmer's investigations (where the real fun begins).

On a personal note, I think it's funny that Drexel stands a very good chance at unintentionally getting what Camelot331 has only been able to fantasize about: a real thread on KF.

Nick himself on stream pointed out how his videos don't get a lot of views and how he runs his mouth. He'd just let him yell at clouds and make fun of his yelling. Monty joked on his stream that he's a nobody. Nick could have just ignored him, or even thrown the occasional barb at him and this wouldn't have happened.
