The appeal was the most foolish, expensive and self-destructive option available to Nick. I tend to think that Nick did it for those reasons. The appeal is also very much in randazza's interests both financially and from a law nerd point of view. From the very start of the lolsuit, Nick has followed a legal strategy of spending the most money possible in the least productive ways.
I agree. Foolish for Nick. Not so much Randazza, who gets paid either way.
I've said since practically day-one that Randazza's involvement here makes little sense
but for his attempt to apply Colorado anti-SLAPP to this case. He'll keep making that argument as long as Nick is willing to bankroll it.
Take that prospect away, and this is a
really bad case for Nick. I think maybe if Randazza weren't trying to make the argument he is, he would have advised Nick to settle. That's last bit just speculation on my part though, and assumes Randazza can spot a case that wouldn't go good for the defendant when it's argued on merits.
The more money, time and effort Nick puts into the case, the more of a fool he makes of himself. Nick raising so little for his case was humiliating enough, but to be out-fundraised by a boomer conspiracy nut has to really hurt.
Not only that, but he thought this case would be an actual profit center. Remember when this started he bragged about how he was gonna talk about it regularly and the money would flow?
Yeah, that hasn't happened. Instead, it's been a total money
drain. To the point where he's openly whining on his Locals about the state of his bank account now. Again, great deal for Randazza though!
