Saying "I have seen innocent people wrongly prosecuted before, I will not speak to the police without my attorney present" is a completely legitimate statement in every circumstance. You aren't acting defensive, you're exercising your leafstitutional rights to a defense.
If he has exonerating evidence that proves, conclusively, that he could not have done it, that's great, and it should absolutely be taken to the police. But it should not be him making that call, it should be his lawyer.
