There are actual international schools of ministry who are literally named ISOM who are largely ignored while this comic book named after its creator's ancestor is being accused of being confused for a company that licenses ministers. This is true. The Indiana School of Ministry does refer to itself as "ISOM". Shit, I mean they both have "School of Ministry" in them.

I do not believe that someone's personal actions have any bearing on whether or not something is copyright infringement. The only pertinent part is whether or not what Eric July is naming Isom is creating brand/copyright confusion, intentional or not, with the copyright holders product of the same name.

The personal actions have a bearing over whether the trademark holder is angry enough with the infringement to file a suit. Also they can argue those actions do not represent their trademark. A big part of why to file the suit is to show they wish to assert their trademark rather than let it appear abandoned.

But the International School of Ministry and ISOM comic are now associated in discussions and videos including Eric's himself. Now if someone of pure intentions were to wonder if they are the same company, the answer is no: I.S.O.M. is suing the nigga capecucks.

The hypothetical customer who would do business with them is either looking to license ministers or become a licensed minister. You are now that hypothetical customer, you either want to license ministers or become licensed as a minister and you'd heard about an "ISOM" which may suit your needs. You go to Google, you type in ISOM, and you see this:

Trademark law probably looks at these matters differently, but to the hypothetical person looking for ministry resources, this is not confusing whatsoever. Let's go further though, because another issue is whether they might construe these as being somehow related. That page returned in the results doesn't use the term "school" or "ministry" anywhere. It never mentions Christ, the cross, any spirituality or religion, and the controversial and "confusing Cross" on the belt? you have to scroll down to see it, and it's literally this:

My setup uses a 50 inch 4k monitor and I only spotted it because I'd heard so damn much about how this cross will make people think "ahhh, so this is that organization that licenses the ministers!" Most people are scrolling on their smartphones. If you hit the "page down" key 5 times, then you can also spot this one:

You'd have to sit through three minutes of being told repeatedly that this is a comic book from a company named Rippaverse before you see this cross. That's three minutes of never mentioning Christ, ministry, religion, or anything related to the ISOM in California. Again, this is from the perspective of a hypothetical person who wants to license ministers or become a licensed minister. Nothing indicates this is even a religious invocation of the cross.

As for the NOW existing drama videos, those videos are centered around how these two separate and distinct entities are now entangled in a lawsuit... how the fuck would that make someone believe they're the same company? That's the dumbest argument yet. A video about them being different companies will make people think they're the same. Makes perfect sense.

Yeah, but that all falls apart if they aren't consistently enforcing your copyright, it becomes un-enforceable. You can't pick and choose who you enforce it against. Eric could be going on every stream and screaming NIGGERFAGGOT for 10 hours, or being the nicest guy humanly possible, doesn't affect enforcement.

Though it would be very strange if they did not indicate that on their website or in their documents.

Good Shepherd has, thanks to Dax, a documented incident of someone confusing their trademark and a comic book. It is a ridiculous incident to anyone reading this thread, but it is enough for Good Shepherd to conclude that they need to try enforcing their trademark and get some money from it. Even if July and GS are in completely different fields, it gives Good Shepherd's claims some teeth.

I went to the Trademark Electronic Search System at USPTO.gov and searched the ISOM trademark. 2 results of simply the ISOM name bounced back.

So, in order for the ministry to win, they have to establish a case that the rippaverse is illegally using the ISOM trademark to market the comicbook, which is actually protected by copyright.

Now to put it in layman terms, trademark infringement mostly refers using the trademarked name in order to promote another similar product. However, these also have very much specific limitations, and usually refers to the brand.

ie. for example, Toei cannot sue walmart for Walmart for selling one piece bikinis because it infringes the One Piece trademark. Sony cannot sue 8-bit do for controllers that says "works as good as Dualshock controllers" even if Sony owns the Dualshock trademark. they can sue mad catz if they says "this controllers have Dualshcok motors"

Now, what does it do with the comic book? the ministry has to try to establish that the comic is branded as the same as their organization or using their trademark to sell their product, which is funny because Isom is a literary work and not a brand. I guess their whole case is relying trying to establish that the ISOM comic is religious therefore tangibly related to their ministry, but last time I check, the ministry doesnt have a trade dress, design rights registration for the cross. weird.
