§ 5-71-215. Defacing objects of public respect​

Universal Citation: AR Code § 5-71-215 (2020)

  1. (a) A person commits the offense of defacing objects of public respect if he or she purposely:
    1. (1) Defaces, mars, or otherwise damages any public monument;
    2. (2) Defaces, mars, or otherwise damages a work of art on display in any public place;
    3. (3) Defaces, mars, desecrates, or otherwise damages any place of worship, cemetery, or burial monument; or
    4. (4) Removes a broken or unbroken, commercial or rock, grave marker for any reason except for cleaning or repair by a family member, caretaker, or preservation organization.


  2. (b)
    1. (1)
      1. (A) Except as provided in subdivision (b)(1)(B) of this section, defacing objects of public respect is a Class A misdemeanor if the value of repairing or replacing the damaged object does not exceed five hundred dollars ($500).
      2. (B) Defacing objects of public respect is a Class D felony if the value of repairing or replacing the damaged object does not exceed five hundred dollars ($500) and if the object that is defaced, marred, desecrated, or otherwise damaged is a cemetery or burial monument.

Better question is whether the DA in Collin's County Texas will see this, decide that yeah... this guy is nutso and this might end up in some sort of breach of peace, and decide to present the stalking shit to the grand jury. @AnOminous pointed out earlier that all felony charges require presentment to a grand jury. That's why it's only just a report at this time.

If Riley were smart, he would have laid low after he saw what was in the police report, but he's apparently gonna keep escalating.

(Actually, if Riley were smart, there wouldn't even be a police report, but I think that goes without saying).

EDIT: Noticed he's said it was a "daytrip" but he's calling it the morning in the video and he first posted the photo at 2:21 PM in his timezone. He clearly lives within a couple hours of the location, which narrows him down even further. The cemetery seems to be in Canehill, Arkansas which is by the border of Oklahoma and MIssouri so that narrows it too.
