It's my understanding JNV is subject to appeal by the prosecution though. Which wouldn't be the case with a not guilty verdict by a jury. If successful, the prosecution could have the the jury's original guilty verdict reinstated.They can't set aside an acquittal. If you're found not guilty, it's game over. They can find a "judgment notwithstanding the verdict" on a guilty finding, though, if there was not actual evidence supporting it.
