I'm not sure this reasoning would survive without "drawing all reasonable inference in Mr. Greer's favor".

This makes no sense unless the copyrights are actually being infringed. The mockery was inspired by the belief that the copyright wasn't being infringed. I don't agree that these inferences are reasonable when they necessitate value judgments of the core contention.

I'm not a lawyer either though so maybe the law would find that reasonable. That's wild though.

EDIT: Ah, I see, they're reviewing it this way specifically because it's an appeal on a granted motion to dismiss. Somehow even though they drew multiple arrows towards this part, I missed it.
