if courts were that easy to rig then not only would this site of been shut down ages ago but this case would not have lasted this long either. until a judge tells null to fuck off he has every right to fight this just as much as the people who come after him do.

i dont know what nulls lawyers plan will be in all this but this is nowhere near the end of the site. this will get handled and we will continue to move forward.

I don't understand the logic of this ruling, what do the suicides, the New Mexico school shooting or the Christ Church shooting have to do with Russel Greer's copyright claims?

Furthermore, how does showing off Greer's lolsuit emails change whether or not his copyrighted materials are being reposted under fair use? You could make any number of arguments regarding parody, educational purposes or critique.

Having admittedly not brought up this case and just seeing it from the feature, this "victory" reeks of a desperate attempt at a "throw anything at the wall and see what sticks" approach. Or, in another way, 'bury the other side in legal headaches and bullshit until they give up" Sad but true, oftentimes weaponizing the legal system is the most effective way to "win" your legal argument.

The facts are “accepted as true” for the purposes of the motion, not for the litigation as a whole. It’s just a construct that allows a court to see if there is ANYTHING potentially contestable or of possible merit that the plaintiff has alleged. And in this case, as stressed multiple times (lol), they gave even greater latitude to construction because Russell was pro se.

It is up to an individual judges discretion, but it isn't completely unusual for pro-se (self representation) clients to have a little bit more leeway than a client with proper representation. Faretta V. California the Supreme Court specifically states that pro-se defendants must adhere to all regular court norms and procedures, but in many real-life pro-se cases, the court's  implied duty of impartiality will allow for a little bit of "wiggle room" for minor errors that a normal lawyer would get ripped for.

Also, gotta love that Law360 article with the side note about how he "suffers from facial paralysis" as if that has any relevance whatsoever to anything relating to this case. Obviously they're fishing for tard sympathy with that one... They could have just as easily said he "Suffers from Astigmatism" or "Occasionally has a bad case of the Mondays" and it would be just as irrelevant.
