Well that's one interpretation. Another is that they were aiming for the church and hit the church hall instead. See how this works? Either way it's a war crime, if they're claiming it was an accident it's on them to prove it. A good first step would be co-operating with a UN inspection and agreeing for this incident, and the hospital bombing, to be referred to the ICC. The Palestinian territories are a signatory to the Rome declaration with Israel previously blocking any proceedings on the basis that the territories are non sovereign entities under their control. As Israel has not ratified the Rome statute they claim the ICC has no jurisdiction to investigate or rule on war crimes in Israel proper or any of the occupied territories.

Israel's position may have something to do with the fact that the ICC have previously made preliminary rulings that they committed systematic war crimes, including bombing hospitals, during the last invasion of Gaza back in 2014.
