Imagine decades worth of copyright law being upended because some gimpy mouthed retard wants people to forget he's a vexatious sex pest.
That sums up most KiwiFarms enemies in a Nutshell. Hector Marcan, Russell Greer, Byuu, Keffals, LFJ, Chris Chan, Yaniv, etc, they all have beef with the Farms mainly because this place documents and archives their fucked up "hobbies" that they'd rather be kept under wraps.
Well, time to buy a shirt everyone.
Null's probably going to need a lot of money to fight this
No, break out your big-boy wallets and get a hoodie or two instead! 😉
Translation;

As much as we’d like to be able to weaponise the law to remove content from the Internet we dislike, one day we might not have the upper hand and the way we are behaving right now could come back to haunt us.
Wow, a few journoscum are still somewhat self-aware. That's shocking in this day and age
Do they consider the relevancy of the facts? Like how posting legal paperwork and mocking/suicides of uninvolved parties has nothing to do with copyright infringement.

If the judge has to treat the Plantiff's statement of facts as true, is there any penalty for making false statements? I would assume that comes down to proving intent, or if a reasonable normie would believe those statements based on libelous news articles.
For the purposes of the ruling that just happened, no. As shown in the files posted above, even then the harassment and Byuuicides were cited as IRRELEVANT AND ALLEGED. As stated before by a few people though, all plaintiff's statements are assumed to be true for the purposes of the ruling at that time, whether they are pertinent to the case or not.
As is, I agree with you, it is completely unrelated. Now is a really interesting question, what if Russ filed for permission to amend in the linkage (if he was smart enough to make use of his bullshit) after the filing of motion to strike?
That is definitely an interesting question. Seeing as how absolutely retarded he has seemed to be thus far, it would depend on what he would try to accomplish, and if the judge would even allow it. Would he try to add more defendants? Ammend for more damages? It could definitely open a pandoras box of discovery if he went uber-retarded, but I doubt the judge would allow anything too crazy, if at all.
if null loses what does that mean anyway? does this give every other lolcow on the site the ability to sue if null refuses to take down their threads? or is russell here a special case?
It should be noted that just because he's asking for $300K or whatever doesn't mean that if he wins, he's going to get that much. Civil suits usually only result in actual, or compensatory damages awarded, especially on a small scale like this. Meaning that he'd have to have done some legwork on real vs. expected income and whatever loss attributed to KF misdeeds. Hurt feelings money and punative damages usually don't factor into anything but really big cases. And it's highly likely that he's still pro-se, I doubt that he would have the brain power to push for anything substantial above legal norms. This really isn't a Google-level corporate case where an activist judge is likely to throw maximum threshold penalties for every infraction at a defendant.
Is it possible that Russhole won his appeal due to bias judges?
That's what this is all about. Well, a big part of it. 85% judicial bias, 15% tard sympathy, 41% autism and 69% activism.

He isn't asking for actual damages. He's actually asking for statutory damages provided for in the copyright statute, which range from a minimum $750 to $30,000 per infringement, and if found to be willful, could go as high as $150,000 if the judge felt it necessary to send a message.

I liked the response to the article. Wasn't deleted yet last I looked.

I updated the archive of the page because a few more comments were added. This guy John Hallington has an interesting contribution in response to Becky here:Screenshot hallington.pnghallington 3.pnghallington2.pnghallington4.png

This guy has apparently created an account to comment on this one issue, (edit: oops, meant to post the archive of this) and I would have said he was a farmer except I disagree totally with his third paragraph. I don't think anyone familiar with the farms, or participating here, would misunderstand the term 'brigading' or otherwise represent us as reaching out to lolcows or somehow deliberately bringing ourselves to their attention, as opposed to taking their voluntarily-posted material back to HQ to talk about in glorious, uncensored peace among ourselves.

Significance level = low, but I thought it was an interesting and otherwise mostly even-handed interpretation from someone who doesn't seem particularly partisan, even if he has misunderstood what happens on this site.

If he loses, or wins but only gets $750 (x2 I assume?) do you think he’ll appeal again? This dick seems like a rash that won’t go away.

This Hallington guy writes like an absolute faggot. “Deleterious”? Go eat a bag of dicks.

brigading is what redditors call it when users coordinate to upvote/downvote specific posts or threads to mess with their ranking system

It's the weasel way of saying "I dislike what they're saying and I think they're a pack of assholes, but nothing they say or do is illegal." He's at least honest enough to recognize that censorious laws are first aimed at scoundrels like us and, despite the fact we're all losers who live in our mothers' basements, we have to be defended if censorship is to be prevented.

On the other hand, I think it'd be a tad dishonest of us to say "We dindu nuffin!" with regards to the harassment some cows allegedly suffer. I can understand how Kiwi Farm contributes indirectly to harassment. There are bad actors looking for people to go after, and Kiwi Farms provides a handy list of such people. Not only that, but we even provide their locations and contact information, a handy list of insults, and like jannies, we do it for free.

Further, you may be familiar with the saying "Any group that pretends to be retarded eventually attracts retards, who believe they're in good company." We're not a harassment website, but we're portrayed as such, so people looking for a private army repeatedly show up here, looking to sic us on their internet enemies. This isn't our fault, but it's an unavoidable consequence of my previous point.

In terms of online ethics, we're in a very interesting position. In terms of legality, we're 100% in the clear.

This Hallington guy writes like an absolute faggot. “Deleterious”? Go eat a bag of dicks.
He's probably a legal expert. He probably needs to get laid.

Ehhhhhh yeah, sort of. In much the same way that whitepages contributes to the harassment and stalking of private individuals by providing collated, highly accessible information about their location, relatives, contact numbers and so forth. I would say that info scrapers like that are responsible for more harassment and probably actual harm to private individuals than the farms, that only keeps track of a relatively small number of the extremely online.

We all know that they really hate us because the cows want to bury the stuff we've archived and pretend it never happened. They want us down so they are free to rewrite the past. Not because we're ebil stalkers irl. Liz 'consent accident' Jones is the prime example.

Damn this legal stuff is making this thread drier than any given woman around Russ. Come on, Russ, sue the state of Nevada while making the Nevada government sue a random law firm for not hiring you which you threatened months ago. Hurry, before Stinkysnack starts writing erotica again.

There's no denying bad actors can and probably do use the info we have here. That said, a cow's privacy isn't our concern, it's theirs.

But yes, I do agree the current wave of Kiwiphobia comes from deranged sex pests wanting to hide their past indiscretions.

Yeah I should have specified that in my reply as well, but the rest of my comment still stands. Even then, damages awarded wouldn't necessarily be the full amount if he wins, that would be up to the judge or the trier-of-fact.

Or "ratio'd"

would have been nice if he pointed out there are facts backed up by evidence like grizzle's court losses for stalking and his kill list.
