A family member can have a court declare someone dead if they have been missing for 7 years, or disappears in "Circumstances of peril."


How do you prove death when there is no body?

When a loved one disappears, the person is not automatically presumed dead. A family member or an individual affected by an order which declares a person is dead (Declaration of Death) must apply to the court to have the missing person declared dead. A court will only make the declaration under two circumstances: the person has been missing for seven years, or they disappeared in circumstances of peril.

Circumstances of peril

After the events of 9/11 and the numerous deaths and bodies that were never found, the Ontario Declarations of Death Act was amended in 2002 to add another presumption of death in circumstances where an individual has been missing for less than the required sever-year period. Subsection 2(4) of the Act provides that a person may be declared dead if the court is satisfied that:
  • the individual has disappeared in circumstances of peril;
  • the family member or interested party has not heard of or from the missing person since the disappearance;
  • the family member or interested party’s knowledge, after making reasonable inquiries, no other person has heard of or from the missing person since the disappearance
  • the family member or interested party has no reason to believe the missing person is alive; and;
  • there is sufficient evidence to find that the individual is dead.
Since 2002, the courts have been tasked with applying section 2(4) of the Act to determine and give meaning to the words “circumstances of peril.” The courts have concluded that a person is at peril due to certain threshold factors external to the person. While different types of external events will be identified by the courts, it seems obvious that the earthquake in Nepal, the disappearance of the Malaysia airlines flight, and 9/11, would constitute the kinds of events that would trigger section 2(4) of the Act.

I think so, too. There've been several recent occasions where he's admitted he's too stressed out to host his show. The fact that he's venting his stress publicly rather than (a) lying and saying he's cancelling for a separate reason or (b) just saying, "Sorry, no show tonight. See you soon!" really shows that the fear, frustration, and sleepless nights are getting to him. It won't be long before he secretly hopes to be arrested just to have some clarity and resolution.

When he talks about that "two year prison sentence", what he's really saying, deep down, is that he'd rather serve two years in prison right now than continue to live in this state of perpetual fear and stress.

How do murder trials swing in Canada? Jury of 12? Judge only? If it is a jury he has a chance playing the reasonable doubt gambit.

I think that the RMPC is trying to catch him out in enough big lies that it could swing a jury. I suspect that the June 19th sighting wasn't real. Long brown pleather coat and a small school bag. Previously he didn't recall what Elora was wearing and that she had gone off into the woods. Now she is wearing a long pleather coat and a small school bag. No tent. No sleeping bag. And now she is off hitch hiking and sleeping with strangers at best couch surfing.

The RMPC is hoping that he will crack under pressure and just spill the beans.

But even if he does not, he is spilling out motives. And the way he personally talks, nearly everyone thinks that he is guilty as all hell. And it is all on video. No need for him to take the stand.

It isn't a slam dunk yet. The RMPC wants a slam dunk.

To add to this, murder trials are automatically tried by a judge and jury unless the accused makes a special application to be tried by a judge alone. It's pretty rare for an accused to opt for that, but it's possible to request it, often when the defense feels like the well of jurors is so tainted by public perception that it would be impossible to form an impartial jury. I've also heard of it happening when the defendant's past is especially slimy and would be admitted into evidence as well as when the evidence is so intricate and complex and favors the Crown so much that it might dazzle an inexperienced, easily impressed/confused jury. It does need to be agreed upon by the attorney general and exceptional circumstances must be laid out to support the request.

I’m mostly just curious if he chimped out and murdered her in a rage or if it was a pre-planned murder.

JF wants everyone to think he’s a cold calculated sociopath but it’s more likely he just chimped out and murdered her like a common angry, controlling asshole. I don’t see JF as a guy who would handle the stress of living in a small house with two babies and needy wife very well.

One of the bigger mysteries I think is if Elora actually verbally spoke with her parents and sister about her taking off on her "adventure" or not just before she disappeared.

Yes, it is possible that JF could have primed her to talk to her sister and parents about this. But if that did indeed occur, that would certainly knock down the likelihood that JF knocked her off. The more complex and more preplanning any given scenario is, the less likely I think it would be to have really happened.

Why has no one heard from her parents and sister yet? You would think that they would say at least something on social media.
