There was an elissa clip where Nick seemed forced to deal with the concept of defamation per se by someone in his chat. He was really not caring hard about it. He also did his usual thing now where he dealt with the situation by misrepresenting his situation and the law as it applies to him.
For example, he implies that what he said is protected speech even though it is in no legal sense protected speech. He goes on along those lines disingenuously mentioning the elements of defamation in a weasel way where he is implying that the apply to his case without saying that they apply.
And he will somehow be able to argue for a summary judgement for reasons and win.
He would be better able to cover up his poor knowledge of the law if he were not so thin-skinned and so willing to go after detractors even when he knows that they are right. But failure and lying is all Nick knows. Its the basis for his entire sad life.
The issue is he's talked in the past about what defamation per se is. When finally called out for it in his chat, he appeared to still understand what it meant even though he was coping about it. The question is why he pretended not to know about defamation per se for months, especially when there's been times where Nick has already seemingly signaled that the eventual fig leaf will be that Quest can't demonstrate actual malice even though it's unclear what Rekieta was even basing his statements on.
I kind of wonder whether there have been similar rants in private to his wife about how this is a totally frivolous lolsuit where he has used arguments about "no damages" and similar knowing he would never be called out for being comically wrong in his legal analysis. The problem is he can't really contradict what he's said in private on his show because even if she doesn't watch his main show ever, Kayla's YT playlist was found and IIRC it had some of Elissa's clips on it and she might find a contradiction on there.
I have a suspicion his wife, who probably is not happy that Nick managed to drink himself into a lawsuit, might insist on him settling if she understood just how fucked Nick likely is in this case. It's not even a question of winning or losing at this point, I can't even comprehend how he can really afford his current legal team all the way through discovery and trial unless his Rumble deal is nonsensically large.
His legal fees must already be multiples of what it would have cost to settle the case and unless he changes attorneys, his legal fees going through the end of a trial are going to be multiples of what has already been spent.
It's not even like Nick is being sued by someone like Ron Toye where his business might be hurt if Nick apologized for saying something negative about him. Monty is random conspiracy theorist gadfly and all he needed to do was say he got drunk and went too far and people would have forgotten about it in two days. He really is like Ralph where he is operating under pure spite and the substances have demolished any guardrails in his brain.
If Nick quit drinking, admitted to being a retard about stuff, and got back to "old Nick" would he be redeemed or would we still cheer for him to fail? I genuinely used to semi-look up to the guy before a lot of this shit came out. I mean there was a period where he basically just talked about what it was like to be a professional, be a man, and have family/christian values and suddenly now he's an alcoholic cuck with no redeeming qualities. Strange downfall.
It's over. Nick has been a full on lolcow for over a year at this point. Nick's attempts at on-air sobriety flounder when he realizes that the fans turned off by Nick going full cow have left and are not going to come back. Another similarity with Ralph.
He has already tried "pulling up"
at least twice (once in January and once after his "beach out west" vacation in June) and neither attempt lasted long. Both attempts were prompted by the fact that he was spiraling throughout November-December and in May, The fact that he has been spiraling just as hard with the whole Eric July shit and is still coping about his drinking (note: back in June he at least admitted he was drinking too much on stream) is not a good sign.
